missed 2 months council tax, £35 court charge

    and your wrong they dont come out on the 1st you can choose the 1st 14th or the 25th so no its not 2 weeks late!!!! that would have been obvious from the DD mandate

    That is at the councils discretion - they are only required to allow payment on the 1st.
    I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.

    True, my mum went to court because she didn't pay her council tax, she told them she could pay it if they changed her date to the middle of the month, they told her she had to go to court for them to make this decision, otherwise it comes out at the beginning of the month for everyone else.

    She told them she had to change it to the middle of the month otherwise she couldn't pay it so they did-> end court case lol. She also had to pay the fees.

    Good for you. But I haven't been scared or intimidated into paying anything. I prefer to be upfront and honest about everything and that, for me, includes paying my Council Tax and NI for the services I receive as an English citizen. If people genuinely cannot pay, then there probably are systems in place that offer assistance. However, that is not what the OP is intimating. They are saying that there was an ERROR, which resulted in the £35 charge, and that they could afford the arrears, but that they object to the £35 charge.

    It may be that the court decides that the charge is unfair - I don't know. But I think the magistrate might want a better reason for bank statements going unchecked for a couple of months than "I didn't look because I assumed everything was going through as normal".

    I still wish Busterkeye all the best with the issue. x

    OP I check my bank account/balance at least once a week, since if there is an error or fraud on the account I catch it before any damage is done, perhaps if you had checked your statements you would have seen that the council tax had not been taken in April, and would have been able to sort this problem before the council started proceedings.
    I would respectfully suggest that you start checking your bank statements regularly, it will help to prevent this happening in the future. If your bank has online banking available then get a login and use this, if not you can get some free home accounts software (like GNUCASH for example), which you can put a starting balance into and create payments. If you keep this up to date with cash withdrawals and card payments a quick check of your balance at a cash point will tell you if something is wrong.
