    so if i pay £35 now then in 2 months time i wont get charged again??? me not think so

    You dont seem to understand the system.

    Once the summons is issued it includes the entire years balance and the court costs are incurred only for the issuing of the summons and/or liability order. Even if you pay the £35.00 now then they will still obtain the liability order unless you can clear the full balance by the hearing date.

    You can pay the 3 months now but the full years balance has become due so you still owe the full balance including the costs. Even if you paid the balance in full and not the costs the liability order will be granted for the costs.

    The reduction that you asked about for paying in full at the start of the year.....
    I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.

    It would have been quite obvious from your bank statements that the DD was not being taken.

    Council tax payments are due on the 1st of the month, so Junes payment is currently 2 weeks overdue hence the 3 months in arrears.

    if i dont go to court and pay the charge it will be £35 if i go to court the charge will go upto £48 and all i will see is the same woman from the council that i talked to today (her words not mine) not a judge to explain my side of the story to

    You have the right to speak to the magistrate at court but the magistrate has no choice but to grant the Liability Order - the council can prove the reminder was sent and therefore the summons has been served correctly. There are very few reasons why the order cannot be granted.
