    Just wanted to clear this point up as it was mentioned by WLITC as well.

    Being discharged means that you are discharged from the liability of paying that debt and by extention any court action that they may wish to take against you.

    What it doesent mean is that they have no right to ever contact you about the debt in any circumstances, There are some legitimate reasons that they may contact you such as in this case and it is ok for them to do so as long as they are not harrasing you or asking you to pay, The same applies for the OR, even when you are discharged there may be reasons that hang about for some time as to why they may still talk to you or get you to help them with certain things. I understand that given the likely poor way that many bankrupts have been treated in the past by debt companies can lead to them being very sensitive about anything that drops through the letter box but there is really no need for any concern in cases like these

    Another vote for keeping the letter.

    It confirms your MBNA debt is part of your bankruptcy.

    Could come in handy if there's any 'confusion' a year or two down the line.

    Okay, I now have the letter and as anticipated its from Eversheds. Now I already know the data they have provided the CRA is incorrect as their entry is already showing up on my Equifax report, so the question now is who do I write too. Do I send the template letter (asking them to update my credit file) to the Leeds address on the letter or the Data Control Officer at EVERSHEDS LLP, One Wood Street, London, EC2V 7WS, which is the address I get if I search the ICO site. Or should it be the Max Recovery address (different address) off the ICO site?

    sorry to bump, but can someone please see my previous post about which address. Really want to try and get this letter sent off today so I can hopefully see it get changed on my CR before my Equifax 30 day trial expires.

    If it's registered on your file as Max Recovery, then you write to them direct.

    Eversheds may sort it for you, but if you ever need to make a complaint then you need to be able to prove that you wrote directly to the people who own the record on your file.

    Thanks Fermi, I actually just called Eversheds and they put me through to Max Recovery and they said that they must have bought it in error (as I'm BR and discharged) and to write to Eversheds at the leeds address and they would probably send it back to MBNA .. which is kind of annoying because if that happens it means I'll have to wait several weeks for it to reappear on my credit file as MBNA and prob will have to start from scratch and write to MBNA again. Anyway, I have done a letter (shorter/tweaked version of the template letter with copies of my docs attached) so hopefully they may sort it some how or possibly include details of my docs when it gets transfered back to MBNA. We'll see ..
