    Guys, at present she is not accepting liability, my accident management company has just receive the witness report and will be presenting my case today or tomorrow to her insurers, the accident management company have booked my car to be repaired tomorrow, I will also receive a 'like for like' replacement car...

    I am worried that if she does not accept liability what would be the outcome? who would pay the costs? The accident management company say they will get there money from the at fault driver, I instructed them as I had a witness so surely they won't chase my insurer? I cannot believe that with a witness they won't accept it.....

    It depends on whether the other party challenge the witness with another "witness." One that suddenly appeared without you knowing they were there. ;)

    But it is a sad fact that this "can" happen.

    I think the only issue I have is the fact that an accident management Co are involved.

    I would have gone my own way and used a trusted repairer of my own, not that's of any help to the OP now:(
