Hi there, following this thread with interest as, like you, I've dithered about whether to try or not. Now feel the time is right but wondering everyones thoughts on what my likely success rate will be? So far all of the charges Ive found on statements have been for overlimt or late fees of £12. Worth my while?0

Yes! well it depends, if it's Barclaycard then from my experience GO FOR IT, they tend to give in as a good will and pay up.Since joining this site I've claimed back £1,151.97 from Barclaycard and £975.83 from Capital One, cancelled my £45/month O2 contract and feel almost FREE!!!0 -
Right then, firstly thanks Mum for letting me know the post had arrived... sigh, anyway on the 7th I had one letter stating that the FOS are dealing with my case. On the 11th they had sent me an offer from Capital One stating that even though they don't think they're wrong they're paying me, not quite the original claim but pretty close to it...
I asked for £1,043.xx which was £844 in charges and £199.xx in interest
I've been offered £904 of charges and £71.xx in interest meaning a total of £975.xx
So it appears my story is coming to an end, I cant thank this website enough, pointed me in the right direction and helped me get my life a bit more organised...Since joining this site I've claimed back £1,151.97 from Barclaycard and £975.83 from Capital One, cancelled my £45/month O2 contract and feel almost FREE!!!0 -
Well done Terry, do you mind if I ask you some advice re Capital One ? I asked them to refund £1091 in fees incl interest, mainly £12 and some £25. I used the templates from this forum. They were aware at certain points I was in difficulties hence now the account is actually with CapQuest, but they came back and offered me £58 !!Did you use the templates or write your own letters and did you try and reclaim using the hardship route if you dont mind me asking ? It great that they have refunded you the majority of what you asked for. I think I am a little disillusioned as I have so far only tried to reclaim from Halifax and Capital One, Halifax said no to £300 of charges and I went to the FOS who have also said no, Im unsure if I should go back to them or not, Capital One have said its their final response on the matter, not approached FOs on this one as I feel a bit deflated after Halifax response. Any advice you may have would be much appreciated.LBM July 2011 - Finally took control Nov 2011 DFD Sometime in the distant future !

I'm in the process of reclaiming from Capital One who, it would seem, always send their first reply back as a final response 'no'. Also they informed me I am out of the 6 year period. I have replied to them reiterating the hardship suffered during the duration of the operation of the account and the charging making things more difficult etc. I have told them I shall go to court to claim the whole amount - a few hundred pounds. I am waiting for their reply.
Don't give up on Capital One, if I were you I would send them another letter using the advice on MSE site. What have you got to lose except for the price of a recorded delivery postage cost?
If that fails then use the FOS. It's free.
Halifax is disappointing. But, the court route might cost you quite a bit.0
