Interesting. If noisy, ( or modified ), exhausts, are legally sold to customers, and if, said, noisy exhausts also pass MOT's, then how can one be commiting a motoring offence? Do they come with a HMP warning?

Don't get me wrong. Theres a young chap, who has a modified exhaust, across the road, from me. Theres not much i can do about it. Its a question of live and let live, to some extent. There also an older chap where i live. He has an old P* 106. Horrendously noisy exhaust, and i'm sure its not modified. He probably does'nt have a clue how noisy it is. Then theres myself. The old geezer, would probably complain about my exhaust, and on, it goes ......... :)

The police can stop and test the noise from an exhaust, my son has been stopped for the very thing. Cant remember the exact level, but it is higher than i thought it would be. Some exhausts are noisier and arent anything that would be excluded by an insurance policy. These are performance parts, maybe hes altered the backbox or done something to the mannifold?

Just ask him to look at making it quieter - he might not know it's so noisy!

There is an official noise level. I believe it is 98db and the Police can check it (badly usually) and issue a rectification notice. Have a word with his employer and ask them to get him to park up at the end of the street would be option one for me though.

Any exhaust must be CE-marked to be fitted to a car used on the public roads.

And if it is marked, it's legal to use on a public road, and has already met and passed every noise test.
Most, if not all, aftermarket exhausts are E marked now.

Yeppers but depends on when it was made. An old Golf GTI is unlikely to have it.

Its why the police just used to hit bikers, easy to check if an exhaust is marked or not.

Police will usually has access to a noise meter and ask the driver to hold the car at steady revs to take a reading. they won't be great at it as it is a bone of contention with a lot of car modified drivers. For example, a Subaru with the dealer option - note factory fitted - Prodrive Performance Pack will fail the noise tests!

But they have never lost in court as far as I am aware, as Prodrive claim they are E marked, and so legal, and the police have never proved they successfully carried out the tests correctly.

^^ MOT isn't about the law, it's about meeting manufacturers specifications (which are tied in to EU regulations for new vehicles). For older vehicles it's governed by the vehicles age and the legislation in place at that time.
My kit-car has the engine from a 1979 Escort Mk2, it's seriously loud (it rattles the drinks glasses in my kitchen cupboard) and totally legal.

Outside the MOT station, there is no law in the UK which governs the exhaust noise level of cars, but as mentioned there has to be E marking. There is however a maximum noise for bikes (because grumpy people don't like bikes).

The authorities could at best use the current law that governs noise levels with regard to noisy neighbours (domestic noise). But the noise tolerance level for this is actually quite high, basically if that car was outside making a racket and you turned on your washing machine, if the noise from the machine drowned out the car, then you don't have leg to stand on.

There's real noise and there's "oh I can faintly hear a car, how rude!!!"
