I never said I did not want to pay but a sharp increase from £34 coming out per month to over £100 coming out in one month when your not expecting it is infact not something I needed to have happen and if it did happen would disrupt things. I have £65 I could have paid (it appears they don't require) but wouldn't be able to manage what could potentially be much more and even double that.

Just because I don't have a spare £100+ floating around in my bank account every single day (which is what would be required here) doesn't mean I didn't have it in me to save and pay up, just not first thing the very next day after clocking what had happened: hence my post on a sunday when I was unable to get answers elsewhere despite my efforts.

Most would have been able to wait for the next day, ring around, see where they stood. In my head I was more worried the next day they would automaticly charge me- getting to them first to ask would make no difference and that this would turn everything up side down.

I don't expect you to understand, I wasn't posting in order people understood how I felt of the sleeplessness or stress this would create. Again I don't expect you to understand, not unless you have been there. I hadn't asked people to understand, people seem not to want to anyway...

Look I going to ask the mods now to close the thead, this is becoming abusive and far from helpful. I had found my answer on the previous page, few seem to care and infact seem intent on pointing the finger rather then being helpful, I guess why this is happening will only be known to the people themselves and to me says more about them as people then anything else.

I can't really see any posts where someone has been abusive to you - just because you were told something you didn't want to hear is not equivalent to abuse. If a one-off payment of only £66 (£100 - £34) is going to cause you so much financial grief, you really do need to have a thorough review of you finances, regardless of any legal niceties concerning the actual deduction of this money from your bank account.

Yes, I had someone answer me this on the first page. I already knew this infact anyway, my question was more how it would happen which again has already been answered.

But you were expecting it. Seriously, if cannot afford an extra thirty pounds, it begs the question, "Why did you have the membership increased and why the heck didn't you cancel the membership when you had the opportunity?" You could always have gone back if your financial situation improved.

Nobody made you spend the money did they. you have to take some responsibility.
Robbing Peter to pay Paul wont hold up in court

That is not a comparable situation at all. She didn't make an error - the gym did and as such she has some protection from the law.

You have no idea whether that will be the case. If you are relying on that to save you, you are naive to the extreme.

This is nonsense. The gym has made an error. They can not just take the balance as and when they fancy it. The DD guarantee precludes such action. To accuse someone of being naive simply because they hope that the gym will follow the law is a bit off, frankly.

But according to jenniewb the gym hasn't made a error though?

Once again I would like to point out that this is not 'discussion time' this is not 'Debt advice' this is a question 'Where do I legally stand'
OP did not ask for advice on her financial situationetc etc etc.
