Anyone know where I stand legally?

Apparently they wont take it all at once (posts below yours) which is a huge relief- I don't mind paying for services I use at all. I just cannot manage them taking it all at the same time without warning.
I had infact been using any left over cash to pay off my credit card, its not been spend on "this and that", its been taken out of the account to pay off another debt. Not that it makes any difference in the face of it all!
You have no idea whether that will be the case. If you are relying on that to save you, you are naive to the extreme. The greater danger, for most of us, lies not in setting our aim too high and falling short; but in setting our aim too low and achieving our mark0 -
OP - you need to go on to the Debt Free Wannable board and post your statement of affairs (SOA) - for whatever reasons, you are living beyond your means."You were only supposed to blow the bl**dy doors off!!"0

And yet again someone posts a simple question and the 'holier than thou' brigade turn up.0

It seems the OP's issue is symptomatic of a more general and widespread problem of their income not able to meet their outgoings, or their income being so little more than their outgoings that the threat of a one-off, relatively small increase in their outgoings puts them in a position of blind panic. A review of the OP's income and outgoings is clearly well overdue."You were only supposed to blow the bl**dy doors off!!"0 -

Did she ask for Debt advice?0 -
I wish I'd never asked!
All I asked was where I stood legally. I did not ask to be judged yet appear to be. Why do you all (bar one or two) see my question as asking to get out of paying:
I AM NOT TRYING TO GET OUT OF PAYING THIS I AM ASKING WHAT WILL HAPPEN WHAT HAPPENS LEGALLY!
As already stated, I thought the excess of money (which isn't that much tbh, like £30 a month) was due to my own cutting back PLUS my birthday money I didn't spend all of PLUS my own cutting back. Truth? Yes I should have taken more care, fact is I didn't. I didn't want nor invite you all to place judgement. Why do this? Seriously, what good do you think it does? Do you seriously think I'm going to sit here, read this and think "...hey, you know what, I didn't realise this was partly my own error!" Doh!..." Seriously, do any of you think that your judgements (plus assumptions that I don't want to pay which I will state again is not the case) are really actually of any help at all? Do you infact realise that all your doing is somewhere between rubbing salt in the wounds and wasting your own time? Why not try to say something productive? Or is this beyond you?
Next time I just wont bother! I take my time on MSE trying to offer advice but it would seem others on here (again bar one or two) prefer to use it to inflate their own pedestal. Why?! Is life really so hard that judging others and not even hearing them out is the best way to spend your day?
And just to add. I spoke to the gym, it would appear that as I continued my contract so too I did my loyalty and they had given me 3 months free. It was not an error on their part, the girl saw the offer code and stated this was written within my contract and is sorry I didn't know this already.

...what if they take it all at the same time with warning?
:jAs I already stated: This would be fine! :j
I don't mind paying, its paying all in one go without me knowing that worries me! I posted this on a sunday when the gyms membership area was closed, they were not able to answer my questions. For all I knew it was all going to come out first thing monday morning and I'd be charged bank fees if I had other direct debits coming through. I wanted to know where I stood if this happened, would there be any way to appeal my situation regarding any banking fees I may or may not encounter, the answer I found out was yes, the direct debit guarentee would protect me on this. Its all I wanted to know.
I am happy- very happy someone was able to answer me on that, others seem to have decided against reading that part (infact my main question) and have decided this entire thread was (wrongly) about me trying to get out of paying: it is not, never was! I like my gym, thr last thing I want is to be blacklisted by them nor to pay for a service I think they provide very well!0 -

Over!
Flipping 'eck, it's thirty pounds. If your financial situation is as bad as that, I would have thought that gym membership is something that should have been cancelled first. The greater danger, for most of us, lies not in setting our aim too high and falling short; but in setting our aim too low and achieving our mark0 -
Yes, I had someone answer me this on the first page. I already knew this infact anyway, my question was more how it would happen which again has already been answered. Then the answer is, "you have to pay the money."Flipping 'eck, it's thirty pounds. If your financial situation is as bad as that, I would have thought that gym membership is something that should have been cancelled first.
I never said I did not want to pay but a sharp increase from £34 coming out per month to over £100 coming out in one month when your not expecting it is infact not something I needed to have happen and if it did happen would disrupt things. I have £65 I could have paid (it appears they don't require) but wouldn't be able to manage what could potentially be much more and even double that.
Just because I don't have a spare £100+ floating around in my bank account every single day (which is what would be required here) doesn't mean I didn't have it in me to save and pay up, just not first thing the very next day after clocking what had happened: hence my post on a sunday when I was unable to get answers elsewhere despite my efforts.
Most would have been able to wait for the next day, ring around, see where they stood. In my head I was more worried the next day they would automaticly charge me- getting to them first to ask would make no difference and that this would turn everything up side down.
I don't expect you to understand, I wasn't posting in order people understood how I felt of the sleeplessness or stress this would create. Again I don't expect you to understand, not unless you have been there. I hadn't asked people to understand, people seem not to want to anyway...
Look I going to ask the mods now to close the thead, this is becoming abusive and far from helpful. I had found my answer on the previous page, few seem to care and infact seem intent on pointing the finger rather then being helpful, I guess why this is happening will only be known to the people themselves and to me says more about them as people then anything else.0
