If Ebay refunded you the money - then i would say that they were then the owners.

As they then said you do not need to return it - that would make you the rightful owner, would it not?

Seller does not seem want to phone up specialist team and says he has not got his money back? If what they told me is correct then it would appear that I have been very generous letting him have the chance to arrange pick up by a courier. Never have I had anything like this happen to me before. My record as a buyer and seller is unblemished, not even a neutral in well over 200 transactions. I think he just wants vengeance because I stood up to him or he is paranoid. Worrying to think people like him are trading but also good to know Ebay can protect you.

if he has kept the money and ebay have paid out then he is not out of pocket. Block him and report for harassment or tell him you have dropped it off at the police station to the lost and found and tell him to pick it up from there (depends if your local station has a sense of humour though)

He is probably all mouth as he is sat (I assume) several hundred miles away behind a computer and is probably trying to scare you into returning it so he has the money and the item. Call his bluff and tell him he can call round whenever he wants. I'd be very surprised if he goes to all the bother for such a small amount of money! I also think he is lying about not having the money refunded by ebay!

I have done my best to clarify it all but have no idea whats happening his end. My ebay account still shows it was paid for - no refund icon on it. I suspect that it would show as refunded if the refund came from his account? Maybe Ebay/Paypal are holding on to it for now? Police station would prob tell me to clear off but would be preferable to having a nutter at my door :-) I may report him or give bad feedback but do not want it to escalate even more.

Seller doesn't need to 'get money back'? It has never been taken from him. You paid him and he has the money. Ebay have not taken it back from him. The email sent to him would have stated that you were not happy and that they are investigating and during this time the funds may be held. They also go on to explain that if they find against him and issue a refund they may recover the funds from him by several means. I think he has assumed that he has had the money taken from him. It's not your problem, and if he can't be bothered to sort it out then TOUGH!

If he turns up then uninvited then tell him to wait on the doorstep whilst you get the item and then shut the door and phone the police if he starts hammering on the door!...LOL

Yes, it is now 100% yours.
It's amazing how some sellers think they always own the goods even though they have still been paid for them.
I must admit, I'd leave a neg now, 1 star across the board, and I'd email the seller telling him that ebay have been very clear that it was mine to do as I wished, and that I had taken it to the local tip.
If you haven't got his address I'd also request it from ebay, just to give him the hint as well.
But then I am large and ugly.

was this not one of those no fault claims where ebay refund you and you dont have to return it because ebay have paid out themselves for the refund? I cant see why else ebay would refund before an item is returned?

Quick update. Seller has kept payment and is not out of pocket. Ebay covered it.

Was it that post that gave you the clue?
