Something unusual has happened here. Are ebay now enforcing a refund without return of goods?

Again it sounds like a no fault refund, which means the seller isn't out of pocket as ebay have refunded you not him.

Either that or ebay are allowing refunds without getting confirmed returns from buyers!

Think you need to call ebay to clarify this right away

ring ebay they sometimes give you a pre paid label to print off which you take to the post office with a tracking number and you do not have to pay for this. I know they did this for my hubby as he had a problem a little while ago.

I was charged £15 for delivery and item cost £20.
The resolution said neither party were to blame. It sound like both of us got to keep the money. Will clarify this with him. Ebay said to sort it out over the phone with him.

I will ask Ebay about the pre-paid label. Sound like the best solution to me.

Quick update. Seller has kept payment and is not out of pocket. Ebay covered it.

What is the law regarding this?

Currently you have goods which you have not paid for, do not belong to you and you don't have permission to have.

You are being unreasonable automatically assuming a breach of the peace will exist.

Also depending on the value of the item, I'd rather collect in person than get an empty box and have no comeback as the sender had a signature and it then ends up their word against mine.

But the seller hasn't lost out, they have not been refunded by the seller - ebay have, as no one is to blame, hence a no fault refund.

I'd be ignoring the seller from now or or referring them to ebay.

You have to find out who actually owns these goods that are in your possession and for which you have not paid. If you own them then you keep them. If Ebay owns them (it looks like they are the only ones who have actually been out of pocket here) then offer them to ebay for them to collect. If the seller owns them, then you cannot refuse them the opportunity for them to collect them.

I phoned up the specialized team at Ebay and found them very helpful.
Apparently they understand the situation regarding return costs and thats why they let him keep the money and I got the refund. They said I am not required to return it to the seller as he has been paid. I let the seller know he has 1 week to arrange a courier and then thats it. He can then probably sell it on to the next sucker.

If ebay refunded and did not recover the sum from the seller then he is not out of pocket and he has NO right to get the goods back. I'd tell him to take a running jump.
