Blocked sewer in Mum's garden

    Well I phone Yorkshire Water on Saturday as my Mum is still having problems with the shared sewer.

    Apparently, according to the person I spoke to, it isn't their responsibility as they haven't adopted that part of the sewer. They've adopted the sewers in the gardens of number 40 to 50 but not any others. And that they were only responisible for the one's that they have a list of. Mum's is no 32.

    I mentioned that the website shows different but she said that she hadn't seen the website so couldn't comment.

    Does anyone have an idea of where I go from here, or have a reached a brick wall.

    Is the blockage in a shared drain, or in a drain servicing only your mother's property?
    If the former, they don't have to adopt it, they are liable for it under the legislation previously advised, assuming the property is pre-1937.
    Ask to speak to a manager and quote them the legislation.
    No free lunch, and no free laptop ;)

    The problem might be who you are speaking to,are you calling customer services or operations ?

    If I were you I would write in so the reply comes in writing and then take it from there as there is nothing to stop the next person you speak to saying something else.
    They should be responsible so ask them in writing why the think they are not. That might change things all together as no one is going to want to put something in writing if it is wrong

    Go back to your Local Authority Environmental Health Department. They will have a contact with your Water Company and should be able to get a difinitive answer on whether it is their responsibility.

    If it IS a private sewer Environmental Health should still be able to help (I am an EHO and deal with this problem all the time). EH should (at least we do) examine the sewer and find out what is causing the problem, they should also be able to determine which houses are jointly responsible for the sewer. If none of the houses responsible take any action to rectify the problem EH should serve a Notice on each house, and then, when the Notice is not complied with, will carry out the work in default of the those responsible and then recover then costs from each house.
