This would mean that if his esa is stopped, they will assume he will claim jsa. However, if he is too ill to claim JSA (I can almost guarantee that signing on will cause panic attacks at the least) we'll be stuck.
Also, they are planning to change ESA so that even the cont type has a time limit. This means that he'll get nothing because of my pay packet anyway... I can't win.Leftie and proud :beer:0 -

WTC is based on the previous tax years' earnings, so if your earnings were over £16k, then you won't get anything. However, if your earnings are the same as they are now, then you should get something.
Apart from 6 weeks where I was either waiting to be made redundant or doing a job that lasted only 3 weeks, I was claiming JSA and my oh was on ESA. This tax year I will earn £17500+, but will get WTC of £4k+ based on low income in previous year + £1940 for additional non-working adult (OH).
Btw, if your OH loses his appeal, just get his Dr to sign him off for a month and they will transfer him back on to ESA again. Worked with my OH.Never Knowingly Understood.

At the moment, with your net weekly income of £210 and your husband's assessment phase ESA of £67.50, you wouldn't qualify for LHA (HB) or Council Tax Benefit. However, if your husband loses his tribunal and stops getting ESA, you will qualify for approximately £18.87 HB each week (can't say for CTB as don't know what your bill is). This is assuming that your rent is not more than the max LHA rate for a one bedroom rate in your area.
Not too sure re WTC, but if your husband loses his ESA you should then qualify for that though I don't know how much.

With HB and CTB it's always better off to work as there is an earnings disregard (currently £10 per week for couples) and you only have to pay 65% of your excess income (over the minimum £105.95 that a couple over 18yrs needs to live on - gov set this) towards your rent."I've fallen down a hole" - said in best Monty Python voice-over.0 -

You appear to have deleted your original post (I wonder why) so it isn't possible to prove that the other remarks in it were simply supporting the OP and complaining that people aren't treated fairly when they have their benefits reduced. If that isn't 100% accurate I apologise, but as you've deleted it I can only go from memory. Anyway I didn't bother to include them in my quote as they had nothing to do with the council house issue.
No need to be snappy about "wouldn't dream of having a discussion with you" - I'm not sure what I've done to deserve that sort of attitude. It isn't okay to have a different point of view about things then?
