I certainly don't agree that ALL private sector workers are scum, but certainly some of brigade on here look like idiots when they keep knocking public sector workers. I bet they wouldn't say the kind of comments they make in real life either! It's very easy to write their crap on here, their just cowards really! :rotfl:I think you need to check this with your employer.
Do you have a contract? Are you able to carry leave over to the next leave year? I doubt whether they will pay you holiday for the three year period.
Private sector workers are scum. (Just as an aside seeing as an insult was thrown at public sector workers above).0 -

Iam surprised that Iam still on the books but hay as i am i might aswell get some money money money as the song goes0 -

You ARE allowed to carry holiday over if you are prevented from taking it by sickness. This is a legal right so "trumps" anything that may be written in a contract.0 -

The OP won't be on the books for much longer I suspect and it does make a mockery of the ruling that allows holiday to be paid when ill but thats the law and you have to obey it.
Also if the OP is ever going to get back to work peeing of your former employers may mean the loss of a reference so that does need to be considered. The Googlewhacker referance is to Dave Gorman and not to my opinion of the search engine!
If I give you advice it is only a view and always always take professional advice before acting!!!

Where have I said anything that is rubbish? It is likely you will be dismissed once you procede with the claim, and there is also a chance you will not get a reference in the future.
Yes you are legally entitled to it and if I was in your position I probably would do the same but I would do it knowingly that it could affect my future whereas you don't seem to able to accept.
As we are asking questions if you were the employer do you think it is fair for someone that has not contributed to your company for the last three years and claim holiday pay? Legal..yes, Fair or moral...IMO No.
And as for the reference, I mentioned it because it COULD (it may not) happen but you have contributed nothing to the company in the last three years then come and lawfully taken money from them and then expect them to give you a reference in the future.
If that happened to me I would not help you in the future with a reference. The Googlewhacker referance is to Dave Gorman and not to my opinion of the search engine!

The problem is there is no guarantee that they OP would get a useful reference even if he / she were to forgo the holiday money.
If a reference is a major concern then the only certain way is via a compromise agreement.
Again, the OP needs proper legal advice. It may be OP has some other possible claim against the company? Is so, maybe this could be waived and settled for "just" the holiday pay and notice plus a legally binding reference as part of a CA.0 -

Quite true and only the OP will be able to tell us whether or not when he went on the sick 3 years ago whether it was with a good relationship or not, if it was a bad ending to the effective end of the relationship then the OP has nothing to lose. The Googlewhacker referance is to Dave Gorman and not to my opinion of the search engine!
