    you had me until you said it was inconvenient to pay now. Inconvenient? You knew they hadn't taken the money so why didn't you just leave it in your account? You won't get any sympathy with that. If you pay and then shoot off a letter of complaint then there is more likliehood of a more postive outcome.

    I don't think they're being unreasonable in the slightest.

    He orders goods
    They deliver
    He spends the money because they never charged his card
    They spend two weeks trying to phone him and get him to ring them back which he doesn't
    Now they chase him for money

    He obviously knew he hadn't paid for the goods since he continued on to spend the money. Knowing he owed them money + repeated phone calls from ASDA doesn't take a genious to figure out what they want.
    Okay so you was working between 12-5PM.. fair enough... but are their lines closed for the other 19 hours of the day? You would have been able to talk to anybody by phoning them.

    Now your saying its "inconvenient" to pay and in effect asking if you have any rights?? You have the right to receive the goods you have paid for, ASDA have the right to receive payment for the goods they sent.
  • Actually I didn't say that I had spent the money nor did I say that I wouldn't pay them - I'm obviously going to pay for the goods that I received. What I was saying, as others did pick up was that it was inconvenient to be penalised for their mistake and whether I had a right in terms of that being acknowledged. Perhaps I didn't phrase it well (although it does seem to me that some people on this site are very quick to jump to unpleasant conclusions).

    The money has always been in the account, they didn't try to take it again.

    The message stated that the line was open between 12 and five. They did not chase for two weeks, they left one almost unintelligible message and one where I picked up a couple more details such as the time they wanted me to call

    I see now why they have the (largely unheeded) warnings about being nice to new people - I thought this was a generally friendly site, clearly I was wrong.

    Thank you to those that did give a helpful and non-judgmental answer, especially halibut - that was exactly what I was looking for help thinking through.

    I accept that I will need to pay them but it is quite inconvenient now, more than two weeks after the shop. Has anyone else had anything similar happen and I have I got grounds to suggest that they now wait for payment until my next pay day or anything like that?

    I agree with points you make about sometimes people do jump to conclusions, however; they are usually with some foundation.

    You are now saying you never spent the money and have every intention to pay etc. yet in your OP you were saying it's inconvenient and wanted them to wait until next pay day?

    Can only assume that you were asking this purely to make things difficult for them following their treatment of you, rather than just saying "the money is there" and moving on?

    If you read my earlier post I was giving honest advice. Pay it and then chase up the way you were treated. You won't get anywhere with the action you are considering. My suggestion might reap more for you.
    Nobody has been horrible to you. You may not like the advice but that doesn't mean you are being got at.

    The suggestion that it is inconvenient for them to take it now and you would like them to wait until next pay day implies that you don't have the funds for it at the moment - either because you've spent it already, or you have earmarked it to spend on something else shortly.

    If you're going to talk to them, I'd make sure you can give a reason which satisfies them that you're not just trying to pull a fast one.

    I had taken the day off when my shopping was delivered and they didn't contact me that day.

    I do hope you're not suggesting that Asda inconvenienced you in the first place by your having to take a day off work to receive the shopping... they deliver pretty much all day.

    That aside, just pay the money. You don't need the hassle of an outstanding debt. There was an issue, they tried to contact you, they've failed so far and are now getting a bit shirty. What are you trying to achieve? Some things just aren't worth pursuing.

    Why are people getting so stroppy with the OP!?!

    It's really not hard to grasp - the OP is happy to pay the money, but it was/is not convenient for them to call ASDA during those hours. I certainly couldn't spend time at work on the phone for a personal call, let alone to ASDA who have atrocious customer service, and VERY slow to answer the phones!

    Pixie of doom, just send them an email saying you received their letter, the money is in your account waiting to be collected, and if they need to discuss it further, then they can phone you on <number> after 6pm Monday to Friday, or between 8am and 8pm Saturday and Sunday.

    No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)
