WMC? I only know Windows Media Centre, and Wales Millenium centre, lol. so I think I can say no, as I dont know what this means. (i'm so bad with abbreviations, sorry)

Actually talking of 1st aider, a lady had heart attack and died a few months back in the bar, the manager was the only 1st aider there, and he was paraletic. But I dont believe he was working, altho that shouldn't have made a difference, She wouldn't have been able to have been saved tho apparently.

And no, there was no other sober first aiders there, everyone bar my son was as drunk as a bar cloth.

He or she means a Working Mens Club!

Just ask for the CCTV - if they refuse you have the right to make a subject access request for it, but they may not know and just give it you - if it still exists.

First aiders are not there for the customers, they are there mainly for the members of staff, if there is a member on duty that is first aid trained then they can deal with a member of the public, other than that call the ambulance.
The Googlewhacker referance is to Dave Gorman and not to my opinion of the search engine!

I know one thing and sorry i cannot be any help on your sitution

I would love to know were they hired this manager from who is abusive to your son,

I know i would not Hire them at the slightest for any of my own offline businesses.

Regardless of Sitution, Employers and Employees are the backbone to any sucessfull business and the manager should of shown a professional approch with his dealings in regard to your son? |One Question i would ask in the investigation would be if i left my medication in work realised i have left it here and came back for it told my manager i have left something behind who agreed and consented to me to get it how can that be a breach of trust when he agreed to the action for my son to get it or was aware from your sons actions was purley acceptable? i know it was not the medication it was tips. However it is property of your sons and not work related property.

Being a employer myself their is no Justifaction for the language your son has endured. It is a real shame you never got a copy of his Foul-Mouth rage on tape via a answer machine or some-sort.

Regards to the CCTV I would seek a copy of that, You are Allowed a copy. Depending on your sons company policy for the workplace,

edit: you mentioned it has been wiped, sorry about that did not see that bit...

Firstly a breach of trust is considered by the acting Manager,(Which will be this drunken scumbag i presume)

It like saying we suspect you of robbing the Business you work for on heresay. Without any justifaction of this or evidence i beleive your son will be fine.

Its like the manager has to prove your son is what he say he is, But From you have told us your son will need to have someone who will be able to take the heat with him as a second and won't be influanced by the manager(Do not know why i placed it like that but i hope you get my point, This manager i presume is some work from sounding of the guy)
"MSE Money saving challenges..8/12/13 3,500 saved so far :j" p.s if i been helpfully please leave me a thank you but seek official advice at all times from a pro

With reference to my telephone conversation with you earlier today, I confirm that your employment with the club is suspended until the outcome of a disciplinary hearing with myself and the chairman at 10am on Friday 3rd June 2011. The hearing will be in respect of your conduct of Sunday 29th May 2001 which is regarded as a serious breach of trust placed in you by the Steward.

At the Hearing, you have the opportunity to explain your actions and you have the right to be accompanied by a colleague or friend.

Can anyone tell me where we go from here, My son is happy to go back to work while looking for employment elsewhere, mainly due to fact he has done nothing wrong, and believes that by facing them, he is proving his innocence. He is (maybe was now) a 2nd assistant, who has been in training for well over 18months and is not being treated as such, he is expected to open up and close up when the 1st assistant is away, and handle monies and cashing up, even when the manager is not there.
Legally does he have a leg to stand on? as he really can't see a career opportunity now, as its not just their trust in him, but his trust in them.

    Everything SarEl said - plus

If they have actually said 'colleague or friend', then I'd do everything I could to make sure your friend was indeed there to support him. I'd not mention her background in any way beforehand [goes without saying but if they have left this door open then it might just be a home goal on this one'.

    My main points would be:
If it is not allowed to return back to work if you have forgotten [or thought you have forgotten something] then it should be stated in their procedures. Surely, most people have returned to work thinking they have forgotten a purse/wallet/phone and found it in their bag [I know I have] and I've never been sacked for it!

I'd also have the route marked out that you travelled from and back to the premises, google maps will tell you how long the journey would take - just to backup the time taken.

I'd also point out that I was with my mother; how many crooks would rob work with their mother in the car?

And of course, that the manager was completely arseholed and as such, was unable to make a judgement call on such an important detail and had taken against me - and the reasons behind it. If I was going down I'd make sure that the manager would come down with me too.
If you haven't got it - please don't flaunt it. TIA.

SarEl, am I right in thinking that if Booie's DS let the manager's calls go to answerphone, that would not be illegal, and they could be used?

Personally I would never take another call from someone who'd sworn at me previously. And it doesn't sound as if he'd be able to resist making abusive calls.

When I was working as a solicitor there was another solicitor in the same field as me, who if there was a dispute about what had been agreed or discussed on a phone conversation, would always produce a transcript, under the pretext that he had accidentally left his dictaphone running when answering the call and captured both sides of the conversation. He was reported to the Law Society more than once and never sanctioned for this, and always managed to get his transcript admitted as evidence if needed.

With my phone, if you answer at the same time as the answer phone kicks in, the whole call gets recorded on the answer phone. If OP's son were to do this for every call for the next few days, he could easily inadvertently record an abusive call

    Just some random thoughts:
    • Did you son have the right to go back in to the premises? I guess giving him a key says he did.
    • Had he ever gone back in before (having forgotten something, or whatever)? If so, then it could be normal practice.
    • Was there actually anything there for him to (allegedly) steal? If not, then what the heck is the accusation?
    • How could he forget tips (coins?) in his trouser pocket?
    • Was there anything going on to make the manager suspicious of anybody (eg. had tips gone missing before)?

I'd not mention her background in any way beforehand [goes without saying but if they have left this door open then it might just be a home goal on this one'. I'll make sure that he doesn't introduce her as anyone personal to the family, just by her job titles and we'll have the letter with us to show that friend was stated.

    My main points would be:
If it is not allowed to return back to work if you have forgotten [or thought you have forgotten something] then it should be stated in their procedures. He has never been told anything like this, he has never even signed a health and safety proceedure booklet.

Surely, most people have returned to work thinking they have forgotten a purse/wallet/phone and found it in their bag [I know I have] and I've never been sacked for it! Yeah, i've done it too, gawd, I've even put my purse in the fridge, and a can of beans in freezer!! we all misplace things and put them where they sholdn't be. My son got alot of grief for not drinking with them, but he'd told them in the week, he was no longer drinking, that he was on a health kick, no smoking either, his manager actually called him a party pooper and boring.
Who'd think you would get suspended from work, for not being drunk!!!. lol, laughable huh.

I'd also have the route marked out that you travelled from and back to the premises, google maps will tell you how long the journey would take - just to backup the time taken. Thats a good idea, I'll do that tomorrow, thankyou.

I'd also point out that I was with my mother; how many crooks would rob work with their mother in the car? He said this already to the boss the 3rd time the boss called ranting and swearing, my son said, my mother was in the car, its like your saying she is aiding and abetting a criminal act, the boss shouted, yeah, see how much effing trouble your in! ......... I actually giggled at that, I was in banking for 15 years, never even crossed my mind in nicking millions, but would risk my freedom for aiding and abetting a bottle of vodka. :rotfl:

And of course, that the manager was completely arseholed and as such, was unable to make a judgement call on such an important detail and had taken against me - and the reasons behind it. He's just said to me about 2mins before reading this, that the secretary had told him on the phone last night, that he was out with his wife and had had 4 pints and didnt feel that he could pass judgement on something he didnt know nothing about with 4 pints in him, yet his manager was over 4 pints when he accused my son of coming back to rob him.
If I was going down I'd make sure that the manager would come down with me too. This is now my sons aim, he said if it all turns to brown smelly stuff on friday, he will make sure that his boss is following on behind him with no paddles either. lol

With all this said tho, none of what was said has any witnesses, except maybe his screaming rant that my son was suspended, coz that came directly after my boy spoke to secretary, so altho everything you say is true, its not going to help with the case as he is being investigated for conduct, and breach of trust. But he is a keyholder and therefore a trustee, it is so pathetic.
