It would be a strange lease company indeed that made no express provision for them to pass on penalty or excess charges to customers (with the addition of a administration charge of course). I have used five different lease companies over the years and every single one of them had a clause similar to this (one I've just copied from a document in my vehicle file):You will be liable for [amongst other things]:
5. All fines, court costs and intended prosecutions for parking, traffic or other offences (including any costs which arise if the vehicle is clamped). You must pay the appropriate authority any fines and costs if and when the authority demands this payment. All fines and intended prosecutions incurred will attract reasonable administration charges which arise when we deal with these matters.
If you are saying that your lease company does not have such a clause then, from my perspective, that would be a first. Don't get confused because this clause places a clear responsibility on the hirer as it importantly limits what the lease company can do. Just because the lease company have levied the charge doesn't mean that they are able to do so legally. I suggest you check the contract again.My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016).
