Fortnums Cars in liquidation!!!

Hi All

I need a bit of advice - I bought a car at Fortnums cars in Fareham in January 2010 and got 4 years free servicing as part of my deal. However when taking it back for its second service they have a message on their phones to say they are in the process of liquidating the company!

Just wondering where I stand with the rest of the servicing I have to use - I also have a complaint outstanding with them as I dont think they changed the oil in my last service resulting in me paying out £850 for a new turbo!!! Had problems with them but dont wanna just forget about my servicing as this is gonna cost me now to keep servicing my car!

I bought the car on finance with them but think I owe the money to Barclays and not Fortnums? Also I took gap insurance out at the time but would this be with Barclays or Fortnums if it is with Fortnums where would I stand with that?

Sorry for the essay just very confused at the moment - I am keeping my side of the contract by paying my finance dont see how they can just give up their side because they are in liquidation!

    Try looking at your paperwork and your bank statements to see who you have contracts with. Perhaps it is with the little pixie or the man in the moon ?

    your finance will be taken over or bought by a third party
    basically you lose

    If the car is on finance then the finance company will be jointly liable for the transaction. If Fortnums do go under then you can make a claim against your finance company for the cost of the missing term of the free servicing. For any other issues they may also be liable.

    i would disagree with that
    the finance will be on the car not a complete package unless the finance house is one of those that does mind boggling aprs

    How do you know they didn't change the oil. Are you basing it on the fact that when you checked it, it didn't look squeaky clean?

    Well the OP did tell us...
    ...I bought a car at Fortnums cars in Fareham in January 2010 and got 4 years free servicing as part of my deal.
    It looks to me as though CCA section 75 will cover the included servicing.
    If, and it's a very big if, the OP could claim against Fortnums for damaged caused by not changing the oil at the last service, then again Barclays are equally liable.

    Clearly the OP needs to look further at who the GAP insurance is with, but that only becomes an issue if a claim is made.

  • thanks everyone gonna look through all my paperwork tomorrow and try and work out what is with who! i think you all kinda confirmed what I already thought :( sadly, was hopin there maybe some little known legislation that I could use, but never mind, and Hammyman I was told by another garage that the turbo can go as a result of the oil not being regularly changed and as my car had had a service a few months before the problems started that is why I am complaining - not just about that but I have had poor service other times too.

  • I bought a car from them May2010. The package included 3 years free MOTs and servicing and 12 months RAC. I also paid for the extended warranty as they said it would give me "piece of mind" and "you will just need to put fuel in it" The RAC knew nothing about it when I called but I didn't really need that so left it. May 6th I booked in my MOT and 1st service. The only date they could fit me in was today 6th June. Drove up this morning (their garage is 10 miles away), to find it all borded up and forecourt empty. They had a poster on window saying shut from 5th May for refurb and number to call. When I rang the number an automated reply said they have gone into liquidation and to write any claims against the company to a PO Box! So they shut on 5th May but took my booking 6th May! Does that mean I have lost what I paid for the extended warranty? I am so cross. I paid the extra for "peice of mind" now I'm out of pocket with a car with no MOT!

    Janiew do a companies house check to make sure they werent trading fraudulently if they liquidated the day before your booking,did they take any more money off you?
