OK so I have just checked tour operator A is offering the holiday at a cheaper price, on the website now. the one that lastminute.com had passed my booking onto.
Cheaper than it is advertised at lastminute.com
Exactly the same holiday and the same price as the other website I found.

But you are too late to put a claim in now ...
    Gone ... or have I?

Yes, you have found the same product, but the claim needs to be submitted within 24 hours of booking.

You are outside LM's time limit for claiming now sadly.Obviously you can try but unless they are in an extremely good mood they will most probably deny your request.
Here to learn and pass on my experiences.
Had a total of £8200 of debt written off due to harassment during 2010 and 2012.

No I need to check if it is exactly the same product i.e. thomas cook holiday being sold at co-op
If it is then the tour operator is the same i.e same product then I have a case, if not then no I don’t.
If it is the same product that both internet companies are selling then I meet their T&C for my original claim.

Just to be clear, on the claim that you have submitted, was the tour operator identical? If not, you do not have a claim.

Thats what I am trying to find out is the compoany that lastminute.com uses selling the same holiday with the same operator as another internet website.
Both offering same holiday dates etc at the same price. I have sent email to then asking which operator the holiday is with. If it is the same then according to T&C the tour operator is the same and I have a claim.

No you do not have a claim today, but you had a claim within 24hrs of booking with LM. That is the point we are trying to make.So LM will most probably use this clause to get out of paying you the difference.

Like I said you can give it a go at trying to get the difference paid back, you have nothing to lose by doing so. But just be prepared that you may not be successful. Good luck though :o

When they say the same product, the product they are talking about is a specific holiday by tour operator A.

Not a holiday from another tour operator which happens to use exactly the same flights and exactly the same hotel on ther same dates.

Ok so I checked, the website that I sent to lastminute.com within 24hours of booking my holiday uses exactly the same tour operator as they do at lastminute.com they are selling the identical holiday tour operator dates hotel etc.
Both holidays use specific holiday by tour operator A.
So i need to send all of this to lastminute.com.
