    I cannot accept this offer of £829 as full and final settlement of my claim. I will accept this as a part payment and without prejudice, but I will continue my claim for the balance.

    Was your claim of £1150 made up of charges only, or did this include interest added?

    Hi All,

    Can anyone tell me whether a Gesture of Goodwill (GOGW) can be used as part settlement or is this something one can keep, as well as pursue a claim for your full unfair charges?? What shall I do.......... help! Here's my story so far, I was offered a GOGW from Smile of £800 despite my total charges being £1150. In fact they put the money into my account without my knowledge and I didnt get a reply to my LBA. When I discovered the funds in my account I didnt know why they put this amount in the account with no explanation. I didnt get any correspondance in the form of a letter, phone call or secure message so
    I put the £800 into another cooperative linked account but havent touched the money.... is this ok??

    Anyway sent a template letter 'Response to their settlement offer' this morning stating that I only will accept the £800 as part payment on the understanding that I will recover the rest through a County court claim if necessay.

    When I got home today ..low and behold they sent me a BACK DATED LETTER which didn't correspond with my LBA dates ( all very convenient ) Smile's letter says ...' £800 has been returned to your account as a GOGW and that they will not refund any interest according to their terms and conditions and that they wont refund any charges unless there's a bank error & giving me 30 days to close my account ( thats fine coz' I've another one - hee hee!!)

    Can anyone give me some advice. Shall I send a secure message asap telling them to ignore the Response to settlement offer' letter and send another letter stating that I accept the GOGW but that they return all unlawful charges imposed on my account of £1150.???????

  • What was the break down of your claim between charges and interest? As the banks are not obliged to pay the interest unless it ends up in court.

    Hi All,

    Smiles' bank charges on my current account were totally confusing. Although, I rang them up I'm not sure if at the time I totalled up the charges correctly. They did pay me £829 out of £1150 I claimed but the £1150 included statutory interest which they wrote back saying that they wont refund any further charges unless theres a bank error.

    Does anyone know what exactly we can claim back - Out of the below:

    Commission
    Commission Refund
    Credit Interest
    Debit Interest
    Fees
    Tax on credit interest

    Have received back a list of charges etc on my account and like foxij i would like to know if i can claim back the commission and debit interest charged to my account (totalling nearly £2000). What are the commission charges anyway?

  • Hi, Just need some kind advice really !?!

    I have an overdraft on my bank of £560 being reduced £40 every month. Before this my cheque book was used with guarantee card without my permission (i couldn't report it due to circumstances) so this person paid me the money back- however I was left with £00's in charges, which I paid.

    I have decided enough is enough when my interest came out a couple of weeks ago and I was left 66p over (my fault granted) i immediately paid in money to cover this within 12 hours. I have just got my statement with charge for £10 going over and a £5 daily charge!:mad: !! I have been with barclays and nationwide and never experienced any charges like this, when going over overdraft by small amounts.

    I am dubious about claiming them because if they close my account will I have to pay my £560 overdraft off straight away? As I can't afford to pay OD off in one. Also I know the cheques weren't issued with my consent but the bank don't have this on record unless I reported someone to the police, so can I claim this back? Also will this affect my credit rating with the bank I am with? and getting mortgages and mobile phone contracts etc?

    Know this is a bit longwinded but wanted to give you an idea of the situation.

    Any information would be greatly appreciated. Thanks for taking the time to read this.

  • Which bank are you with?

    All banks can and some do close accounts and/or call in an overdraft, you do need to be aware this might happen.
  • i'm with smile internet bank - part of the co-operative
  • Not too many users with Smile. I would send for your statements/info and at least calculate out what charges you would be able to reclaim.
