    Have opened and escualated the case, If they haven't sent the item then this will prob stop them from doing so, if they have sent it then I wont answer the door to the postman or collect from delivery office so it will be returned to them without me having to pay for it.

    If it's sent tracked they only have to prove attempted delivery to win the case. So make sure it's not a tracked service.
  • If my postie leaves a card (hes pretty good with the cards) it will tell me if it requires a signature, if it does I guess I will collect and pay to send back.

    A seller needs to prove delivery.

    A buyer returning only needs attempted delivery/delivery or refusal to win a claim.

    Had an email asking why I opened a dispute when they told me they had sent a replacement, haven't responded to them, atm I've not received anything in the post, they post first class and claim to have sent it Thursday night/ Friday morning and by comparison I posted an item Friday afternoon and buyer received it yesterday morning. I know some things can go through the system quicker that others but I'm starting to think they didnt send the replacement, won't know for sure for a few more days though.

    I should disregard their communications from now on and not get involved in any discussion. Let the dispute run its course.

    Just a quick update, had the red card yesterday and replacement dress is sitting in the delivery office. Had an email from the seller saying if I close the case they will refund me and let me keep the dress.

    Just wondering, if I close the case and they don't refund where do I stand, would I then have to go through snad?

    If you close the case, you'll never hear from them again, and you can't open any other case after.
    Tell them to refund you, and say nothing else that could be mis-construed.

    Totally agree with Mikey don't close the case as you will then have no leverage and be unable to open another one.

    I think if they refund it automatically closes the case. It sounds like they're trying to play you!
