hi my wife has epilepsy and has done since 2003 , we only just last year thought to claim for dla allowance also i was going to taking a much lower paid job (10k less) my wife has nocternal focal epilepsy which they only occur in her sleep , she gets vacant moment in the day sometimes , i had to change my job to look after her as i did nights.
she needs somebody with her all night to keep an eye on her that is what i do , we applied last year and they said we wernt entittled to anything so i appealed along with a letter from her clinical eppilepsy nurse it took 3 months to go through the tribunral court but we ended up getting high rate care and low rate mobillity .
she has really suffered this last year with fits biting through her tounge , she has been face down on her pillow somtimes when the fits have started ive had to wressle with her to turn her over into the recovery position , she becomes incontinent i have to deal with that along with taking unpaid time off work to see to her the day after a seizure cooking for her helping her walk after the fit (pulled muscles).
we have been getting £360 a month from dla and now they have reviewed her again they said we arnt enittled to anything again this really upset my wife and that night she had 3 cluster fits and was reallt in a bad way , we would really struggle without the dla why are they so mean:mad: ive no idea where to go next , we can appeal again but in the meantime we arnt getting the money what shall i do is there anyone out there whos been in the same situation , to cut her from high rate to nothing is a bit harsh?

Your options are (a) ask for a Reconsideration, or, (b) lodge an appeal which will include a Reconsideration.
A Reconsideration can look at any additional evidence you are able to present in the next four weeks and will be handled by another Decision Maker from the one who has handled your case already.
Did you get a Statement of Reasons from the Tribunal that awarded your wide DLA? This will show why they thought she was eligible.
If you haven't got it already, ask the DWP for the medical report from the latest review.
Is your wife seeing a consultant? Did they provide evidence?
Try contacting the CAB or Welfare Rights as they may be able to help.
You have a narrow window to change the minds of the DWP, or you're going to have to go to appeal, which could take a year or longer.0 -

Not the first case I have heard of epilpetic who does not have seizures during the day as in grand mals, having dla wiped out. For some reason they feel as long as happen in the night the person is okay to function normally during the day. I have seizures at any time and still get high rate care low rate mobility. I think and know it is stupid but feel they think that if you have them during night and not day that you are at no risk to yourself. Up to you to fight.
I have done some really dangerous things when recovering from seizures off in supposed happy land with carers freaking out and me being none the wiser and got so fed up of waking up on the floor in embarresing places to not go out any more, recluse.
Between you and me the fact we still have two arms and legs as another epileptic quoted and unless flat on our face in front of the examiner, they are unlikely to pass us as can say look you look okay and that is how atos will no doubt deal with it along with mental illnesses that cannot be seen with a microscope probably.
Best to create paper trail and know it sounds creepy, but video tape your partners next seizure, dont tell her as might distress her, but if they ask describe how bad it is, say I will show you, my family have recorded me, but I say again do not let her see as I found it very very upsetting.
Get that reconsideration in and good luck. Nice to hear you are caring for your partner as tiring as it must be, my ex just left me there on the floor as was not very understanding.0 -

This shouldn't matter, as plenty of claimants are awarded purely on the night time care needed. Op did you have help completing your form? Are you sure you have enough evidence in each section about the care needed, time taken etc? I always keep a diary to make filling out my son's form easier. Sounds like you have no choice but to go through the rigmarole of appealing again
Tomorrow is always fresh, with no mistakes in it!0 -
I'm a somnabulant who suffers from blackouts, only get middle care and low mobility as I don't have the care needs regularly enough during the night to get the high care component. Could it be that your wife doesn't have the care needs often enough any more?0
