I don't know if it would have any effect on the outcome of a dispute, but it may be worth highlighting the fact that the glass is broken (and hence could be dangerous), and should not be sent through the post.
However well it is wrapped and padded, there is always the possibility of a shard of broken glass piercing the packing and possibly a postie as well.
If you mention that, and also state that you've given the seller a chance to collect the fish tank, they may (unlikely, but you never know) give a refund without you having to return it.Generally, Royal Mail cannot carry items which could be dangerous for our staff or vehicles.0 -

I got it sorted by calling them a lot on a number I got from saynot0870.com (I think it was on 020 8605 3000) and arguing the toss. Perhaps you could get a damage report from a local fish shop?

how/why did the seller escalate the dispute - surely the buyer would have raised a SNAD first?
I dont know why people use ebay as much as they do (including my husband). Such damage in transit is bound to happen, easier to buy locally!0 -

That's true - I received a marble statue that had been virtually smashed in the post and had many sharp edges. I emailed the seller with photos of the damage and he agreed that it was daft to post it back to him and he told me to just throw it away and he'd refund me in full.

I did but then he asked Ebay to get involved with it and they replied and said I was to return it for a refund at my cost. I'll prob post it via royal mail exactly how it was sent to me (with tracking) and see how he likes getting a box of glass shards back0

Before you do anything I think that you need check whether you are allowed to send broken glass. I don't think that you are. I would check that & if you can find proof on courier & RM website I would get onto ebay & email the proof.
Recorded delivery will be no good whatsoever as it rarely gets signed for & if it does the website doesn't track.
If you have to send it back I would send it courier. What are the dimensions & the weight? You will obviously need to pack it really well to prevent the poor sods who have to handle it from injury.
But check that you can send it first.
Is the damage easy to photograph?0
