Without any independant witnesses and neither party accepting liability surely it will just go 50/50.
Not neccessarily.
At the end of the day, the insurance company work for you, and you can refuse a 50/50 settlement and ask them to take it to court if it gets that far.
A good statement, lots of photos and drawings of the area can make a good case.
Where the damage is, on both vehicles, can quite often point towards blame too.
If the van was pulling out from a parallel parking space, and all the damage is on his front end and the op's car has damage on its side, then that's pretty obvious what happened.
I've had a couple of accidents where the insurance company tried to go 50/50, but when i refused the other party eventually admitted liability0 -
I'd hope not considering where the damage is, it shows the OP's husband isn't at fault.Sounds as if he didn't check his blind spot before moving off(its massive in vans).0
