    Not neccessarily.
    At the end of the day, the insurance company work for you, and you can refuse a 50/50 settlement and ask them to take it to court if it gets that far.
    A good statement, lots of photos and drawings of the area can make a good case.
    Where the damage is, on both vehicles, can quite often point towards blame too.
    If the van was pulling out from a parallel parking space, and all the damage is on his front end and the op's car has damage on its side, then that's pretty obvious what happened.

    I've had a couple of accidents where the insurance company tried to go 50/50, but when i refused the other party eventually admitted liability

    I'd hope not considering where the damage is, it shows the OP's husband isn't at fault.Sounds as if he didn't check his blind spot before moving off(its massive in vans).
