Accident, person to blame not reported it *UPDATE*

    OP there is a good chance the local garage did not give you a courtesy car, they may have put you in a credit hire car, which is basically a hire car at inflated prices. You will have signed a credit agreement that could potentially leave you liable for the costs which can often be thousands if they cannot recover the cost of it from the other Insurer

    Update,
    my husbands car is a write off and the cheque is in the post.
    the van driver is now trying to blame my husband for the accident, on what planet he lives i do not know.
    theres no way if you see the damage to both vehicles that my husband could have been at fault.
    front of van damaged and left hand passenger side of husbands car.
    my husband has provided a statement.

    what usually happens in situations like this?

    The insurance companies will decide between each other but may take some time to do so. I am guessing this cheque is from your insurance company? So you are now waiting for (hopefully) them to decide that it is not your fault, reimburse YOU the excess and your insurance the remainder of the payout, at which point you will get your NCB back.

    You'll find its the insurance company, they always deny blame unless it's a rear end shunt. Also going "50/50" benefits both insurance companies, they both get to make money from the accident (remember it's not their money).

    The biggest mistake in any accident is to trust the other driver is acting honestly, get out that fancy camera phone and photograph every angle without using the zoom.
    record the name and full addresses of the other driver and those of anyone who saw it happen
    My advice here is, to find a private accident specialist solicitor and keep your insurance company out of it or your premiums will treble for the next few years.
    If you can prove the other guy is at fault, you have not had an accident the other driver has and he is personally liable, also you do not need to make an insurance claim, the other driver does as it was his accident or he can pay you out of his own pocket.
    Get the phone book out.
    My other thought tells me the other Driver has got a bit cockey and his feeling his chin a bit, a quick word with the traffic police may bring him round, get your husband to make a complaint of driving without due care and attention, they will have to investigate, you often find that they soon remember who's fault it was.

    he did call the police after the accident, but they said it was a non reportable accident

    there were no witnesses to the actual crash but there is one witness who can verify exactly where the accident took place.

    Do you mean he wants to complain about the traffic police's response at the time of the incident? If so anyone can make complaints against the police - google ipcc.

    But if you mean can you report the other driver, you will find the police don't get involved in incidents when no injury or offence is involved, and will consider this a civil issue for you to sort out yourself.

    we did take the first offer, but thats due tothe fact that it was about £500 more than we thought wed get.

    were just going to wait it out and see what the insurances come up with.

    Without any independant witnesses and neither party accepting liability surely it will just go 50/50.
