Accident, person to blame not reported it *UPDATE*
Hi, my husband was in an accident on monday morning, where he was driving along a main road and a guy in a works van pulled out on the main road from being parallel parked at the side.
my husbands cars entire front quarter is wrecked. the guy admitted liabilty and gave all his details, insurance etc to my husband, my husband didnt give his.
so we contacted our insurance and took the car into the nearest garage, which gave my husband a courtesy car.
the guy at the garage reckoned the car would be written off.
when my husband my phoned our insurers today to check what was happening, he was told the guy hadnt contacted his insurance so effectivly hadnt admitted liability.
my husband has the guys mobile number, should he call him up and tell him that he needs to contact his insurers, or wait until his insurance contacts him?

my gut reaction is to avoid any personal contact as it could be misconstrued (intentionally or otherwise!). someone who actually knows something about this may say otherwise though!:happyhear0

Leave it to the insurance company to sort out. Have you got legal cover? If so, you may need to use it to sue the other guy down the line.0

ill have to check our policy and see if we have legal cover.
oooh fingers crossed.
i hope the guy(he was pretty young, maybe mid 20s) has just not realised he has to phone his insurers, and is not avoiding blame etc0 -
It's early days yet, they do a pile of paperwork and by the time they hear back from their client 2 months have gone by.
BTW - It couldn't possibly have been the van drivers fault, they never do anything wrong..... So prepare to be flamed off the forum by our resident commercial vehicle drivers“I may not agree with you, but I will defend to the death your right to make an a** of yourself.”

Contact his insurance yourself and ask what's going on. I would also suggest using them directly to repair your car. It will be cheaper for them and less hassle for you as it cuts out another organisation to mess things up.
You need to speak to their 3rd party claims department and get someone there to contact the driver, at which point he may admit liability to his insurance company and you can proceed with the repair through them. OTOH he may deny liability in which case you may be best using your own insurance company for now.0 -

This, otherwise you lose your no claims bonus until the claim is resolved which can sometimes take years.
Edit: Oh you've already started claiming off your own insurance. Whoops. Just remember this advice for next time.0 -

OP has already been advised it will probably be a WO.
Do not contact the other insurer, make use of the courtesy car before it is taken from you.0 -
i would call the firm, rather than the driver.. he may be trying to cover up the dents etc from them as well!Long time away from MSE, been dealing real life stuff..
Sometimes seen lurking on the compers forum :-)0 -
we did contact his insurance first but they told us we had to go through our own insurance.0

Lets remember this is a works van, so will be insured on a blanket policy. It will take longer for the info to feed to the relevant people on the claims desk who can tie the two claims together.
As for liability (comment about NCB being lost and dragging on) would be pretty hard to explain the damage to the car on the front passenger panels without the van driver being at fault....
Dont stress out, let the insurance companies do their jobs.0
