Hi All,
Just spent the last 20 minutes with three who inform me that the lack of notice and detriment doesnt apply as it was a free service which is now chargeable. I asked where that was covered in the terms and was told it wasnt. However, the agent also said she didnt have a copy of the terms so no idea where the answers were coming from.
I've completed the online complaint form, but it states that the service level is 14 days which takes you past the acceptance of the new terms - handy that ;-)
If anyone has any luck , please let us know the secret!

Argument is that it doesn't meet criteria of Additional Service. However they now try and describe it, it needs 30 days notice if not an Additional Service. Can back it up with reference to them saying thr service was free - there can be no charges outside of your mobthly package, so it's certainly not meeting their definition of Additional Service in contract.0 -

you should get an email with a case number either today or tomorrow after its been logged, then they say they will get back to you within 5 days..
which leaves very little time to get it sorted before the 6th.
I can see us having to do it the hard way, PAC, cancel then small claims :mad:0 -
What happens if you are 2 months into the contract, would they want the phone back or does it belong to the customer0

This is exactly what happened, I got the email back with a case number and got told that I'll get a reply within 5 working days. Which is a whole week. But to be pedantic I'll phone them tomorrow and find out how long does it take to get the PAC. I think it should be a day or two. Then if they don't terminate the contract, I'll cancel, followed by the small claims court.
The thing is, I quite like 3. I like their data plan and would gladly just switch to PAYG. That way my bill would go from £60 to £15 pcm.
What bugs me is that SMS messages for the carriers, in this case 3, are free. To them this is pure profit. Charging for the reports is just a p*** take. They could just say we will increase the price of the SMS. As I think that they've already done on the PAYG plans where the SMS are charged at 11p.0 -

But me and Mrs 8 have both had texts informing us that from June 6. Three will be charging 1p per text for each delivery report.

Terms and conditions specifically exclude the handset from them, and state and relevant terms and conditions are sent with the handset. General consensus seems that once past the initial 14-day cooling off/cancellation period, the handset is yours to do with as you please.
Think of it as a gift to entice you into taking a long-term contract with them. They change the contract, the gift is still yours. Google for "selling contract upgrade handset" for more advice...0 -
