  • i phoned otelo and they were still waiting on a decision from the ombudsman - i got the opinion that the guy i spoke to basically had no new info on the matter.

I asked him if a bought out my contract and if it was found i had a case with the introduction of this charge would the ombudsman ensure any cost to me was refunded and he said they would seek to get that back as a resoloution to my case.

So i bought out my contract the other day and currently have the mobile that 3 gave me on ebay to recoup my initial costs.

Prob worked out more costly in the short term but felt good leaving 3 although they tried hard to keep my business and were offering discounts and refund of past charges incurred due to delivery reports etc they also explained that i could switch off the delivery reports to avoid future charges.

Just think they are missing the point that if i sign up to a fixed term contract paying X ammount a month I dont expect to have charges forced upon me or lose services which i signed up for expecting to have full use of within my monthly cost.

I know this scenario wont be to everyones liking but only cost me £84 to buy out my contract and mobile should hopefully sell for approx £65. I am now currently using tesco pay as you go mobile which cost £29 and on tarrif of 8p a min 4p a text so will do for now till the ombudsman decides. Oh and the delivery reports are free although more of a hasstle to request

This is going very slowly but it looks as though im one step closer.

Asking for further information on how the change has effected me.. presumably to see
if its over the 10% change that makes its a detrimental change..

    Dear Mr snakeeyes21

I am writing to request information regarding your complaint with Three at the request of the
Ombudsman, in order for us to decide if your complaint would fit within our Terms of Reference
    please provide the following information:

    • To what extent has the change in terms and conditions affected your bill?
    • What difference has the charge concerned had on your monthly bill? (i.e. how much
more is your contract costing you now in comparison to before the delivery report charge was
    introduced?)

Please quote your reference xxxxxxx when you contact us.

    Yours sincerely

    xxxxx xxxxxx

[SIZE=-1]I have also had a similar exchange with the Ombudsman. I explained that as I stopped requesting reports the actual change was negligible, however I've sent my bills showing how many messages I send and therefore how much extra it would cost me now compared to when reports were free before. Apparently the main Ombudsman is still looking into this and has not yet reached a decision.

  • Anyone wrote to watch dog?

No, but they will need thousands of people to get in touch before they will investigate..... Maybe if we all submit the same comment in a short space of time it might get their attention quicker.
  • Well as expected this is going so slow... But i can see the
light at the end of the tunnel now, so thought I would update
this, seeminds its all but died a death on here.

Further letters from the ombudsman, my complaint is within
their scope of investigating it... They agree that its a change of
my terms and conditions... Guess its now a waiting game to allow
the cogs of the corporate beast to get oiled and start turning.

I have a feeling that once 3 are contacted by them they will
    back down.

Over and out, watch this space for next months episode... where
all you good people could have a rock solid way to get out of your
    contracts...
