Hi pizzle,
the depopsit is what you give to your LL usually before the start of the tenancy. If the tenancy qualifies it should be held in a govt approved scheme and you should be given the "prescribed information" about this scheme. Normally the deposit is returned at the end of the tenancy minus agreed deductions for cleaning or damages etc.
If you have a problem getting the deposit back you will need to discuss this with westminster and others more qualified.
In theory if the LL did not put the deposit into a scheme AND serve you the information there should be a penalty of return the depoist in full plus 3x the deposit. But it does not always work out like that.

I moved out of the property over 6 weeks ago and haven't heard anything back from the DPS. We've been waiting on the paperwork so agree/disagree with the amount of deposit the LL wants to repay but we still have nothing. Iv called the DPS and they've told us to start the repayment claim because the LL hasn't yet. What happens then? is it true if they dont respond after 14 days the repayment claim being started then they have to pay the deposit back in full?0

In 6 weeks the LL hasn't send you any schedule of proposed deductions?
So I would start a claim to the DPS immediately stating that the disputed amount is 0 and that the whole deposit should be returned.0 -
Thanks for the reply. Nope the LL or LA hasn't done anything. I know the LL has been to the old house to have a look but the DPS say they haven't heard from them. Im going to start the claim on monday and ask for it all back because its been 6 weeks......what happens then?0

Your LL might contest that there is no proposed deductions, but he would need to prove them. Was an inventory/schedule of conditions produced when you moved in and when you moved out?0 -
yeah we had a checkout done. The guy doing it said all the LL can really contest is that the carpets needed cleaning but that the carpets should have really been replaced before we moved in. We left the house sparkling! We'll pay for the carpets to be cleaned but its just taking so long and we owe the deposit £ to my parents who want the money back....understandably. Surely they should have started the repayment process by now!0

Do as jjl suggests and start a single claim for the money, DPS will then try to contact the landlord, if they get no answer from him in a certain time (not sure how long) then they will just pay you back.but that the carpets should have really been replaced before we moved in.
Have you got that on the inventory in writing? Because if they are going to be replaced it may well be a 100 per cent wear and tear situation where you should not have to pay for anything towards them.0 -
no we never had a copy of the inventory. Theres was only one copy and the letting agent had that. We just checked it and signed it at check in and check out.0
