due care and attention charge

Hello

Last year i was driving through grovers lane which goes from Abercynon to Pontypridd town near my home just after it had rained and after about 2 weeks of warm weather, so the roads were a litte slippy with all the tree sap and grease on the roads, I was just about to go over a small bridge and clipped the kerb and hit a lampost,

I phoned the police imedietely as there was no witnesess and no 3rd party except the lampost

The police arrived quite quick and took a statment along the lines of i was talking to my girlfriend as i was slowing down for the bridge which is on a sharpish bend and only one car can pass over at any one time and before i realised what was happening i was heading towards the lampost and did not have time to react .

He said he would be reporting me for due care and attention and he could either take it to court or take a driving course for £280 and would recieve the paperwork in the post,
My partner was in the car and as a result hurt her neck which the officer advised her to seek medical help which she did, The car was a complete right off and the insurance paid out on the car and for her injury.

After about a month the only letter i had recieved was from the police about me taking a driving course and i would recieve an application for the course

After about 4mnths i did not recieve anything so thought that it had been sorted and the officer wasnt going to say what he said


Well nearly a year later and i have recived a leter saying i had not attended court and had been fined £80 3 points and £280 court costs, I called the courts straight away and explained that i had not recieved anything in the post and could he have a new date set to ask for the case to be reopened which was today 5-5-2011

I went to court today and asked thet the case be reopened and they asked why i had not recieved anything in the post to which i replied i had no idea as there has never been any other problem with me receiving my mail

They have set the date of the 2-6-2011 at 2pm and advised me to seek legal help, This is where i hope that you can help me.

I will be contacting a solicitor in the morning but wondering what your thoughts are on this please

    an immediate note, contact the CPS without delay.. Explain that there has been a most frightful mix-up with mislaid post, and plead for a renewal of the original offer to let you "take a driving course for £280".

    This was all that was needed, ignore the rest. The poster has probably wasted 20 minutes of his life typing crap which he will never get back again.

    If you would be nice and kind enough to go back and delete most of your post, I'll pay for proper typing lessons for you.
    you could have that lot typed in less than 3 minutes if you were a proper typist.

    As an aside.. if the employment of a poster limits the usefulness of his advice on matters of criminal law, shouldn't there be disclaimer to that effect in his forum signature?!

    Thanks for the advice, Do u think a quick call to the cps will let me take the course rather than me go through all this with the courts and possible face charges and points?
