I see your a regular MSE troll. Congratulations. :T

Ah, so correcting patently false statements and questioning absurd advice is now 'being an MSE troll'. Gottcha!

My 73 year old mother does not watch TV, she listens to the radio.

In April, I purchased a Hi-Fi System from ASDA Direct for her, using her details.

Today, she has received a letter from TV Licensing to advise her that ASDA notified them she purchased a "tv related" item and that she needed a TV Licence or had to go thru the lengthy No Licence system (again).

I understand that companies must by Law notify TV Licensing when tv related items are purchased - but his was a bog standard Hi-Fi.

    1) surely ASDA are breaching Data Protection Laws by passing my mothers information to a third party?

    2) will ASDA cover the cost of time/postage in dealing with this - the last time we had to convince TV Licensing that she didnt watch TV, it took several letters over 2 months.

This has really annoyed me and I've written to ask that ASDA write to TV Licensing to explain their error.

has anyone else encountered this problem with ASDA?

    Paul

Dont think Asda will help you out there matey. Usually a phone call to TVL is all that is needed to explain what has happened. They may want to send round a TVL Goon, so it might be best if the occupier calls if she can. Otherwise if a TVL Goon is deployed I will say do not sign ANYTHING if they ask you to sign paperwork. You could land up in court. Good Luck!

I strongly recommend not to contact TVL/BBC under any circumstances.

You are under no obligation to do so.

If you contact them, they will not believe you and will insist on sending one of their goons round. As they work for commission, he will then use every trick in the book to convince you that you require a TV licence and tricking you into admitting you did not have one. Next thing you know it will be a court summons. There are plenty of tales on this message board and others where TVL have come across all nice and next thing they know - court summons.

If they turn up, simply close the door and do not engage in any conversation.

I also suggest the OP makes his/her mother aware of this so she knows what to expect, and how to deal with them correctly.

Yes. Make a complaint to ICO.

Can you provide a link to any where a person with no TV ended up in court?

  • I just told Asda to sod off, It is nothing to do with them whether I have a TV licence or not. They asked for my name and put refused to give info on the form.

This is Big brother gone mad, It is just another way for companies to get info on their system I am absolutely livid.

I could buy a TV off Ebay and no details need to be given. The government needs to do its own work.

I have a TV licence by the way but this has infuriated me. It is not for any retailer to police my taxes.

For any prosecution for no TV license they need a Person to attach the summons to, for this to happen you need to give them your name and then again confirm you are that person. No name, no summons . you are Under No legal or lawful obligation to give your name to anyone unless you are under arrest. That includes police officers, plastic coppers, enforcement officers of any description or people working for a private company checking TV licences. You can only be arrested on suspicion of committing an arrestable offence. These are your rights and people died for them. Show some respect and fight for them.
The reason you spend 10 years at school answering to your name is so you get used to it and fall for it. Never answer to your name in person or on a telephone until you establish why they want this information. ask them theirs they will soon tell you that you carn't have it.
