OCUK - Faulty Motherboard

Morning everyone,

New here and hope I can get some help with my situation!!

On April 26th I ordered some computer components from OCUK (Overclockers.co.uk) the items were dispatched on the 27th and arrived the 28th. All good so far...

Upon opening the motherboard Asus P8P67 Pro for building my new system I immediately noticed after removing the CPU socket cover there was a single bent pin. So the item is faulty!!

I rang OCUK immediately and was told any damage to the CPU socket is not covered by warranty and they told me they would not replace, refund or repair as they could not rule out user error.

I explained it arrived in a damaged condition but i was fobbed off and hung up on. I have since written a letter/email stating the Sale of goods act 1979 and again I have been fobbed off.

What else can I do?

    its proving that you did not bend the pin yourself thats the problem

    That's what they said which is basically telling me sorry mate we've got your £125 sod off!!

    I have read some of the consumer rights and it states it's up to the retailer to prove it was NOT damaged before I received it.

    There response was "All items are quality checked before leaving the manufacturer, so there would NEVER be bent pins"

    Well that's lame because everyday people buy items which are damaged and have made it out of the manufacturers hands!!

    they claim it was checked, again your problem is proving it was not

    So do I have any options??

    Don't fancy being out of pocket £125 and having to spend more money on something I have already purchased!

    I'm just playing devils advocate , only route left are moneyclaim online but the points I made above will be the ones they defend on , ie

    customer damaged when installing CPU

    we quality check all items before despatch

    OP - did you notify them within 7 days in writing that you are rejecting the goods and want to claim a full refund ?

    Another option is to make a S75 claim (if on Credit Card)

    They are known for terrible customer service, hopefully you paid on credit card, think that's the only way with them to get any money back

    I phoned them as soon as I opened the motherboard and saw the damage, I emailed them the same day...
    Hi,

    I have spoken to Consumer rights UK who have advised me to send you an email. Please see below.

    On 26th April I bought an Asus P8P67 Pro motherboard from you for £123.32 which has arrived damaged.

    The problem is one bent pin in the CPU socket of the motherboard, this was apparent upon removing the CPU socket cover, I called your support team immediately and was told you would not RMA the board due to the type of fault.

    The Sale of Goods Act 1979 (as amended) states that when a consumer buys goods from a trader they must be: as described; of a satisfactory quality; and fit for any purpose made known at the time of sale to the seller.
    This legislation also states that the seller, not the manufacturer, is legally obliged to sort out a problem if the goods do not meet these requirements.

    The Sale of Goods Act 1979 (as amended) says: if goods break within the first six months after purchase then there is a presumption the goods were faulty when sold.
    My goods are not fit for purpose and I wish to claim a replacement or refund of my goods under the Sale of Goods Act 1979 as amended.
    Please respond to my complaint within 14 working days from receipt of this letter.

    Dear Sir,

    Bent pins is not covered under warranty and the bent pins are never found on new motherboards as they are quality checked before they leave the manufacturer and we do not check them when they arrive with us.
    If possible can you provide me the 6 digit number on the stock label for the motherboard so I can look into the history of the motherboard and see if their is anything I can do for you.

    I already know from phoning them that they will check to see if the motherboard was a new item and not one that had come back from a buyer using the stock label number... And I know the response will be manufacturer QC them.

    I think my only option is to try and claim back from my CC, but there is no guarantee this will work either...

    I had a similar problem with OCUK a few years back, but as it was only for £30 I let it go. I never bought from them again and it has cost them a lot of money over the years as everything personal and business I was buying from them up to this point.
    They would have no case to answer on a money claim as SOGA say they must prove it was not faulty for up to 6 months after purchase. This is something they could not do unless they had very detailed photos and buyers names beside every product they ship out. The motherboard would also have been in a sealed box so the "we inspected it before it left" excuse is a bit thin. A court would ask for proof of the inspection so if you threaten them with a letter before action, they will most likely give in. You will win, the problem is most people, like me, can't be bothered to fight them.

    They said they don't check the motherboards... It would be Quality Checked at manufacturer. Also Asus boards are not sealed!! Makes it so Asus can resell without stating an item has been opened/refurbished.

    I'm now looking into the S75 stuff... so much legal stuff I need to be a bloody lawyer to understand it all.
