If i were you mate i wouldn't bother with all the hassle for the sake of only £400. its not worth it in my eyes but it might be a matter of principle to you.

Thanks, Thats much better than just saying i am wrong.

The OP won because nobody turned up to fight the case. Not really a win. Could be contested as the buyer did not know about
    the court case.

Transfer of ownership conditional on payment was only added after the original posts, I have my doubts about that. But still
say proving in court that they never paid in full would be difficult.

All the buyer has to do is say he paid for the car the next day and the seller never gave him a receipt or they threw it away
after the log book came through.

Good news.... Its taxed until 2012 but not insured.

Don’t really see what difference me itemising your mistakes makes, they are still mistakes that you wouldn’t have made had you read the thread.

Anyways, none of it is relevant, the OP has a CCJ against the buyer and if he can get the name and address of the current registered keeper and can confirm that it is the same person he sold it to then he can send the bailiffs in to collect the car and anything else they can lay hands on to cover his costs.

As you say the buyer might not have turned up originally or might apply for set aside and defend by saying he did pay for it/didn’t get a receipt/the dog ate it etc and the judge will decide who he believes.

Exactly.... So the judge will decide who he believes... With the OP having no proof the buyer did not pay.

My money is on the buyer.. Even if he is a real person. And not used a fake name.

No comment on the lack of insurance? Important point that, very useful....
