Spoiled Holiday due to denied boarding by easyJet

    They get a refund of the ticket as well surely?

    My advice is take the offer. I strongly doubt you will get anywhere with a loss of earnings claim

    Easyjets argument will be that as you never went on the holiday you could have gone into work and not lost any pay. You chose to still have those days off and therefore it is down to you to suffer the loss of unpaid leave.

    yeah its understandable.. i wish i could go back to work and earned that money and never complained about it.. however our holiday was planned some 6-7 weeks before our departure and our employer made a locum arrangement for our absences so there was no chance

    what exactly is the current offer of £1100.00 from eazyjet for. what have they stated that this is? is it a refund of ticket & cost of accommodation? is it denied boarding? is it just an ex-gracia payment.

    My initial view (although i do not have the documentation to hand) is that if the £1100.00 is for loss of flights (therefore a refund) and loss of accommodation, then i would suggest that you also persue for denied boarding. after all, this is paid in addition to any refund or alternative compensation.

    Have you put it in writing to Easyjet that you wish to persue a claim for denied boarding IN ADDITION to what you ahve already recieved.

    Thankfully, in this case, as the event happened in the UK, you may get some backing from the CAA.

    Thanks HXDave for your information and sorry for a late reply.
    Yeah we did get the refund of £1100 from easyjet last week into our account. They haven'e stated anything like its denied boarding/ex-gratia/just a refund but what i gathered from our correspondences is that it was a refund of air fare and compensation for loss of accommodation.
    However i must admit that they have handled our complaint to our satisfaction (very prompt as everything was sorted within couple of weeks of denied boarding; always apologetic; took disciplinary action towards ground staff at Liverpool airport; gave a courtesy call that money will be deposited)
    so we decided not to peruse the case any further and take the amount which we paid for flight/hotel in the first place.
    Many thanks to all of you money-savers who contributed to this topic.

    If that payment was for loss of holiday accommodation & flights, then from what i see you could still persue a claim of Denied Boarding' under EU261/2004 Article 4 (Denied Boarding). Denied Boarding is explained under Article 2 (Definitions), subsection (i).

    Whilst you have got your holiday money back, you could always use the money from the denied boarding claim to cover your holiday time from work.

    Yes, in this instance. "heres all your out of pocket expenses" really isn't enough. You should pursue the "denied boarding" compensation.
    I would be heartbroken to watch a plane take off, that I should have been on but for someones misguided mistake.
    Its not just the money. For me its the planning, the research the anticipation and run up to the holiday.
    If the flight had been cancelled- fair enough , things happen , but in this case, Easyjet got it well wrong and should at least offer some goodwill.

    Many horror stories come from liverpool airport.....such as "your see-thru plastic bag for liquids is 1 inch too big.....or, the baggage handlers need more time to rifle thru your suitcases.

    Just to add my 2 pence, my wife and I experienced the same nonsense, but this time at London Gatwick flying to Istanbul. We also claimed through the easyJet system, but our claim was denied and they insist we needed visas! Currently looking at legal redress, we thought of complaining via the CAA and getting a solicitor involved to word a strong letter - can anyone suggest legal experts in aviation? After that I guess it is small claims?

    Does anyone know if our credit card companies would provide some kind of insurance? ALso, my wife has travel insurance, can we use these guys to get our money back and the denied boarding compensation we are due?

    Dear algin8, as per the private message I sent you, it would be really kind of you if you could share some more details about your case through PM, so that we can demonstrate to easyJet and to prospective judges that this is not the first time easyJet have misread visa requirements.
