IMO - It's not your fault, the driver is at fault 100% as they were overtaking and it is the responsibilty of the person overtaking to ensure that they do so safely and without incident. So, I wouldn't pay or agree to anything yet and go to CAB to find out your legal rights. There's no need to pay 300 quid if a free trip to the CAB could save you that.
Also IMO: The driver caused the accident. The horse denting the car door was the result.0 -
Why are horses even allowed on the road? It is a mutually dangerous place for both animal and car/bus/lorry so surely they should be kept separate for the better good of both?!
And in answer to the OP, my blunt opinion is the horse your daughter/you were with caused damage to something and the 'victim' is asking for a small amount of compensation to forget the whole thing, pay it and then ride it round a field instead...0 -

Regardless of wo we think is at fault, the OP's daughter will (I hope) have some form of third party insurance and should just pass all the details on to the insurer.0 -
Where do A roads come into it?
Horses are more likely to frequent B roads and more particularly unlassified roads. These are roads that are more likely to have tractors, horses and other livestock and as such drivers should be expecting the unexpected.
Some of us still live in areas where it is common to have sheep all over the place. Kept off the A roads normally by cattle grids and the like0 -

a very long time ago a horse careered across the road in front of the mini I was driving - crapped all over the windscreen and dented the bonnet and ran off, hotly pursued by the owner who was trying to move it from one field (on a B road) to another. If I recall correctly my boss (for it was his car) claimed on the insurance and we got nothing from the horses owner, the insurance company weren't interested in pursuing a case.Bern :j0

Road tax is actually vehicle excise duty and is determined by the vehicles C02 emmissions, so some cars are exempt due to their low emmisions rate, horses and cyclists would also fall into this bracket. It is not a tax for using the road.
