Basically - it means that the Credit Card company are jointly liable and therefore you can claim your money back from them instead (Assuming that the seller does not respond)There can be problems if the card is accepted by a different business from the one that provided the goods and services. We see this situation most frequently in connection with timeshare and holiday club membership, where it is not unusual for the timeshare or holiday club company to use the credit card facilities of another business. The business accepting the payment may simply be acting as agent for the supplier, in which case section 75 will not apply. In order for section 75 to apply, the business that accepts the payment and the supplier have to be "associates", as defined in the Consumer Credit Act.
I paid using a service called SagePay - sort of like PayPal without the good customer service.
They processed the payment (another thing that tricked me, the green 'verified' sign, Chrome telling me its 'safe')
I emailed SagePay and they said to contact the seller and their job was only to process payments.
so the transaction didn't take place directly with Videocameradirect.

You will probably find that you have seen the last of your money.
A bit like sending £5k by Western Union.
Or like putting £5000 cash in an envelope.
Section 75 of the Consumer Credit Act 1974 makes the credit card company jointly liable if things go wrong.
In this case they are jointly liable with Sagepay for providing the service that Sagepay committed to. I.e. passing the money to the seller.
SagePay have fulfilled their part of the bargain.
Your credit card company took no part in the transaction of selling a camera by the ultimate seller.
So they have no liability.0 -

Unfortunately, it may now depend on any goodwill from your Credit Card Company.
More and more (dodgy?) websites are using third party providors like Paypal (and Sagepay) because they know the loopholes in the protection.
Apart from low price items (usually on ebay) - I would never use Paypal. I don't know if they've been reading this or something, but just now they sent me an email for the first time in weeks saying
"We have not supplied a tripod. If you are still not in receipt of your order then please contact your card issuer and instigate a chargeback to recover your funds

I asked them to refund it since I sent it to them directly instead of the bank hassle,
I just hope the bank will help me out. The woman I talked to told me they will 'definitely get my money back' last time I talked to them, when they told me I had to wait 15 days before reporting.0 -
