    With regards to HappyMJ's advice, if he does threaten police, locksmiths etc and you say this is illegal, surely if I stand my ground & do not let him have a walking posession order-then legally I am ok? Does that mean he is just making illegal threats that cannot be carried out anyway?

    Yes it unlawful he is overstating the powers he thinks he has (read the national standers for enforcement agents)

    He has confirmed via text to me today that we now owe £1053.79. Monthly thats around £87, which we may just be able to afford. If we agree to pay monthly do we ask his office to write & confirm

    do not under any circumstances agree to a payment agreement with this bailiff
    if you must do anything send him a text telling him you have sent a letter to the council and B&s informing them of your vulnerable status (unemployed and 38 wks pregnant)

    leave him to reply let him hang himself as with most bailiffs if you know the correct procedures he should be following he will go away because he knows he cant hoodwink you
    I am not an expert I am self taught i have no legal training any information I post is based on my own personal experience and information gained from other web sites

    sorry but i disagree this letter can be sent by e-mail therefore no costs involved

    The reason i always suggest this letter (or similar)should be sent is because bailiffs take there fees first from any payments made to them therefore as an example
    if you pay a bailiff £200 and they have added unlawful fees most of this payment would go in bailiff fees and very little will have been sent to the council
    you must establish how much you have paid how much has been charged in fees and how much has gone to the council
    I am not an expert I am self taught i have no legal training any information I post is based on my own personal experience and information gained from other web sites

    Thank you! Text sent, now lets see what happens!! Do feel far more confident in ignoring the door ( if he now bothers turning up! ) now that I am fully aware of my rights.

    Just had a reply to my text ( in which I told him I was fully aware of my legal rights with regards getting debt returned to council and having them recover weekly via my JSA ) it reads as follows-

    ' Communicating by text is not possible please call me thank you'!!

    What do you think?!!

    Well he managed to communicate via text that it isnt possible to communicate by text?????

    I would say he is being obtuse, hopes you will phone and he can talk you down.

    I have no wish to communicate by phone as i prefer to keep a written record of all communication I am also 38 wks pregnant and do not want nor need the stress as stated i have informed you of my vulnerable status please refer back to the local authority

    I just replied that I wasn't able to call and just wanted to inform him of the situation to save him a wasted trip today!!:D

    Update, new text from him-

    ' I have tried to call you several times and consistently i cannot get through please advise via text a convenient time to call you many thanks my regards robert the bailiff'!! I kid you not, word for word this is his text!!!:D:D
