I can't see anywhere where it says that the inventory specified bed frame and mattress only that the tenancy agreement said bed. You believe that bed automatically means bed frame and mattress. I believe that bed can be taken to mean bed frame only and have had inventories use the word in this way.

Tyler80 - I don't believe that bed means bed frame and mattress, I know. I am English and the word bed is english so nothing to dispute !!

has anyone else noticed that the OP appears to have gone some time ago and left you guys to argue the definitions between you?

I bought a bed last year. It didn't include a mattress. According to the OP this should give me the right to call the police, and have them bring a criminal charge of theft against the shop!

Casper_G - no you bought a bed frame, calling it a bed, knowing exactly what you were buying, so that's just silly.

GDB2222 - and your point is what - theft is the act of stealing and that what has happened it seems, so not sure you have a very good dictionary if you think otherwise

the dictionary definition of theft is not particularly, the legal definition is though, and this is not going to meet the legal test, in my view anyway (quite apart from anything else, you cannot steal something that someone has never owned - in my view any possible criminality would have to be a fraud act offence attaching to the payment obtained from the LL).

in any case, even if you think that it does meet the legal test, in practical terms the police are not going to allocate resource to investigate this and even if they did the CPS are not going to accept the file for prosecution even if the police did investigate it.

the most the LL could hope for from the courts would be a civil judgment requiring the return of the mattress or a payment to the LL by way of compensation. not worth the bother - attempt to recover through the deposit scheme, if you lose give up on the grounds that it's only a mattress (which it appears the LL didn't actually pay for anyway).

p.s. the OP keeps going on about "it was only part furnished". whilst that has no particular definition, my own impression formed from looking at and renting part furnished places is that part furnished means there is a bed and a sofa, but not much else.
