property taken by tenant on leaving

hi,

my friend rents out their own house with an AST tenancy agreement. the most recent tenant took some items from the house when they left, and are unwilling to return them :mad:
My friend is pursuing this formally through the TDS, however i think he should pursue this as theft.
am i right in thinking this and if so, shouldnt he report it to the police?
is there a time scale that he has to report it to them, or can he do so at any time?

    Were these things listed on the signed inventory from when the tenant had moved in?

    Has the checking out process been done?

    This is the most important thing.....

    You have to be able to show something was there in the beginning in order to assert it is no longer there.

    As to theft - how will you prove it?

    The goods are no longer there - who else had access to the property? What proof is there that it wasn't the owner (member of the family) who has taken the goods? How many tenants were there? Which one might be responsible.

    I think the police will be reluctant to pursue this as the losses are covered by a commercial contract and there are too many factors where someone else may have had access.

    It's not theft as in a criminal offence of theft so police won't be interested. It is a civil matter.

    It's only theft if there is dishonest intent. So, there's probably a bit more to this than the Op told us. What does the tenant say about this?

    Has the whole property been searched properly ?

    Sometimes Ts don't want the LLs junk cluttering up the place and will bag up unwanted items and shove in loft/shed/outbuildings/garage.
    Inside this body lays one of a skinny woman
    but I can usually shut her up with chocolate!

    When I thank a post in a thread I've not posted in,

    Renting a property out is a BUSINESS, not a favour or a hobby. The landlord shouldn't leave anything in the property that they have a personal attachment to. Any items of furniture, household appliances, etc. should be generic items that the landlord won't miss, and can write off as a business loss should they go missing, without any heartache.
