You are basing your argument on semantics. The court will not accept this.

If you explain the situation to Groupon they will refund you. I have had refunds outside seven days several times.

Yes I am basing the argument on semantics. Thats precisely the issue.

Like I say, they are contractually incorrect to cancel all 3 reservations since vouchers can be gifted. Even though there is no limit on the number of vouchers that can be gifted they could have said we'll honour one of the three reservations. But they decide to cancel them all. This is just an attempt to wriggle out of it by them.

I've operated within the T's and C's. I've not done anything that was not permitted in the T's and C's.

You have operated with your interpretation of the t&c's. You knew full well what they meant, but you thought you could get around them. A district judge is not stupid, they will tell you exactly where to go!
    Gone ... or have I?

Where does it say that it was one voucher per customer? - It doesnt
Where does it say there is a limit to the number of vouchers that can be gifted? - It doesnt

    The fine print stated:

"1 Groupon per transaction, may buy multiple as gifts. "

Well I guess then my bookings will also soon be canceled, I booked two rooms...

On another issue. What would be happening if I cancel a booking with voucher? Can I reuse the voucher for another booking is this voucher then not good anymore? Will they refund me the £5 for the payment which they deducted.

    Many thanks

the general T&Cs for all say:

The fine print says “Limit 1 per person” and “May buy multiples as gifts.” Can I buy myself some Groupons as gifts to myself and use more than one?
No. If the fine print says this, you can only redeem one. If you buy more than one then you have to give them away as gifts* to other people*.

    http://blog.groupon.co.uk/universal-fine-print-and-deal-faq/

You cannot honestly think that one person can buy 3, give all 3 as gifts to a second person, then that magically allows the second person to use all 3 themselves.

If that was allowed, then there wouldn't be the restriction in the first place - as everyone could just get someone else to buy them and 'gift' them and the giftee could use as many as they want.

    That's just silly.

    *note the plural used here.

hmmm...which of the 3 should they not have cancelled? the first, second or 3rd night? And if they had cancelled 2 and not all 3, then would your friend have opted to rebook the other 2 nights at the same hotel via alpharooms or another agent/direct with the hotel? Or would your friend not have wanted one night only, and then be stung with a cancellation fee if didn't want to keep the reservation on the one night alpharooms didn't cancel?

in respect of the general t's and c's for all:
Q: The fine print says “Limit 1 per person” and “May buy multiples as gifts.” Can I buy myself some Groupons as gifts to myself and use more than one?
A: No. If the fine print says this, you can only redeem one. If you buy more than one then you have to give them away as gifts to other people.

    The fine print actually said:
    Expires 8 June 2011.
1 Groupon per transaction, may buy multiple as gifts. Groupon can be redeemed against any room on any date on offer on the website at time of booking, prices will vary with demand. Groupon activates Fri 8 April 2011 at 2pm. Order online at https://www.alpharooms.com using Groupon codes. If total value of accommodation is less than £50 balance will not be refunded and will become forfeit.

It does not say 1 per person.

Therefore that term in the general t's and c's is irrelevant.

In respect of the rebooking that I will make. None of the three nights will be rebooked with alpharooms. If they had handled this differently or contacted us prior to cancelling then we might well have said fair enough. compromise with cancelling two and leaving 1 night as it is. But that hasnt happened.

    What happened to your friend?!

Has the Groupon injustice proven to be too much for him?

I hope that he can find his way through this...
