Can I offer 50% Full and Final?

Hi,

Can anyone give a definitive answer to this please :

Got a £60 ticket from Excel parking in Swansea for overstaying in a 3 hr free parking space by 29 mins.

So I replied to the letter politely explaining that it was a genuine emergency that had held me up, and mentioning that anyone else who had overstayed by say 6 hrs, would have received the same ticket even though they overstayed 11 times longer than me.
My next words were :

In view of this, I have enclosed a cheque for £30 in the hope that you will accept it as a full and final payment in view of the circumstances and the relatively short 29 minutes I was delayed.
If you will not accept the cheque as full and final payment, please return it to me and we will discuss a reasonable solution further.

I also wrote “full and final payment” on the back of the cheque.

They just cashed the cheque, and sent me a letter saying “now give us the rest!”

So does anyone know definitively where I stand here? I don’t want to end up in court on a bluff.

    Writing 'full and final' has no legal standing whatsoever...even with the letter you sent.

    Read any of the thousands of other PPC threads...the answer is to ignore everything from these scum and to not pay them a penny.

    You will see exactly what threatograms the PPC will now bung at you to try to get you to pay. Debt collector letters, the lot - same as we all get when we all ignore these fake PCNs.

    I really hope you never, ever, ever fall for this s.c.a.m. of fake PCNs issued by cowboys, ever again. This has made me very sad to see that you have actually helped Excel continue with their slimy operation - you've fallen for it and PAID them some money(!!) - and then you criticise the advice we give?

    Should have ignored them. Why didn't you just do an internet search of the company first? Not only is there a ton of info to tell you to IGNORE them, but you'd also know that Excel never do Court except when they tried, and lost.

    Did you really not realise, having joined this forum, that this so called 'parking charge notice' was all a generic scam and you've been had? If not then clearly the best advice was indeed 'read the stickies'.

    You were given the correct advice, so don't criticise ! By the way were you parked in parc tawe by any chance ?
    Excel Parking, MET Parking, Combined Parking Solutions, VP Parking Solutions, ANPR PC Ltd, & Roxburghe Debt Collectors. What do they all have in common?
    They are all or have been suspended from accessing the DVLA database for gross misconduct!
    Do you really need to ask what kind of people run parking companies?

    There is no definitive answer. Unfortunately, your part payment has encouraged them. The part payment has no weight or benefit to you, nor has your appeal.

    This is a great example of why the widespread advice of ignore, still holds true for the majority of cases.

    I would imagine they will harrass you much more before finally giving up, than they would have had you not responded. I doubt they will take Court action ultimately.

    You have fallen for their scam. I personally wouldn't pay them the remainder but only you can decide.

    Just ignore everything else they send, any damages the landowner would have suffered (which will be nil) would have been covered by your £30 cheque (to the sum of £30 more than damages).
