    That again is complete baloney. You bought a printer, not some cardboard. unless he can show that the wrapping was material to the contract (I'd love to see him try), then it does not matter about the box so long as it is returned in some suitable packing to prevent damage

    Ok... think people are being a little unfair to the trader here....

    The stock email you have received seems to be in connection with returning items under the distance selling regs (ie unwanted) rather than faulty goods.

    He has issued you with a return number and therefore you can return it as requested.

    A company is perfectly entitled to inspect a faulty item before issuing any form of refund... things like consumables (eg the fuse in the plug) and damage caused by customer miss use is not covered... it is very understandable that a trader would want to rule these out before handing back the money/ sending a replacement otherwise people would forever be having items break down just before their warranty ran out and getting a full refund before the trader has had chance to notice the inside of the TV is now dripping wet... a lot more difficult for the trader to then try and get their refund back again

    i do understand the point of the seller wanting to inspect the goods before refunding but what im disputing is the fact i have to cover postage.............

    does anyone know how much it will cost to post to middlesex

    It is normal course that you should incur no costs. If the item is faulty, then no contract would be deemed to have existed, and all (reasonable) costs associated with a return would need to be refunded. For this to happen, however (as Astaroth pointed out), the trader may like to first confirm that they are faulty (or rather prove that they are not). If the trader cannot establish that you are wrong, then he must refund costs of postage.

    Getting someone to do that is a different story. You say he is a private seller when he is in fact a business. If your printer were a car, the situation would be a whole lot different.

    im not disputing the fact i need to return it first but i have got this email off the seller;-


    Please goto Amazon market place terms and conditions and see your

    i asked about how much it would be and was told about £8 - surely this is refundable if the printer is found to be broken, but, how can i trust that the guy will say it is broken?

    Iit may be quicker ringing up the makers directly as often they send out replacements and collect at the same time

    That latest e-mail he sent you is totally wrong.

    I had a similar problem with an electrical item that we had acually had in the house about 3 months before it started going wrong. Also cost about 8 pounds to send back and the company (Empire Direct) tried to fob me off saying the return costs would have to be paid be me but I checked with Trading Standards and that is not true.

    Also, the onus is on the seller to prove it was not faulty when they sent it. I sent them a stroppy letter quoting them what TS told me "you have not completed your side of the contract by supply faulty goods, the return postage is an out-of-pocket expence which should be refunded by you". I enclosed a copy of the receipt from the post office. Got my refund plus the 8 pound! Try it!

    This is a one man band outfit not a national retailer you can rant and rave all you like if he dosent want to refund you he wont, you will have to take him to small claims court.

    well - ive explained to him how i didnt have the box and am sending it in a different one - also, as it isnt working i cant take the ink out so im sure it will leak allover (which i told him) he just said still send it - should i go ahead and then file for postage costs or should i get straight to epson and ask them for replacement? i have no paperwork receipt - just my amazon account details with the transaction showing.......

    If its Epson they will ship out a replacement and collect the faulty one at the same time at no cost to you or take it into an Epson approved repair centre there are quite a few around the UK mainly independant PC stores , thats the route i would take.
