printer just bought broke

i bought a printer through amazon 2 weeks ago and now that has broke on me - i am waiting for the seller to contact me as it was through the market place part......how long should i wait to be reasonable and before i contact amazon itself?

    Send another email in a week, if no reply to that after 3 days then ask Amazon for a refund.

    Sorry to hear about your printing problems. Please tell us exactly what
    the is the problem.

    Under the terms of Amazon market place you have to return the printer to
    us for inspection. Refund is only possible if the printer was returned to
    us unopened and not used within 7 days.

    Please let us know and if you need to return it and I will issue RMA
    number for return.

    crumbs thats not a lot of good. Dixons will party on this though at last a supplier that makes thier service look good lol

    That response is utter complete rubbish. Was it a private seller or a trader?

    he was a private seller but i read his profile and that first and saw all good reports for him so i went ahead - he hasnt replied to my email so im going to go straight in and let amazon sort it by filing a charge back - not patient to sit and wait lol

    Reading his profile, he appears have 79 brand new printers for sale so I would say he was a trader rather than a private seller.

    Agreed - the seller will be classed as being in the course of business. Let Amazon sort it - the seller is obviously not totally committed to his legal obligations.

    thanks - he sent me another email this morning saying more or less the same as the one before but with a number to quote on the box - i do not have the original box as i always unpack and chuck the outer boxes as i dont have the space to store........but, he said in his terms it must be in the original box.......do you think i will get refunded? why oh why didnt i just go to comet or somewhere and get one?
