I went to see a solicitor today and have been advised the following.
Firstly there were 2 offences, I thought there was only the offence of driving the taxi as the cops gave me a producer. Now when I replied to to the first summons I only sent back my response regarding the private hire offence.
They also wanted details to show I was insured to drive a normal car. I assumed as they gave me a producer and I have subsequently been to the police station to show my valid insurance docs that was fine. The only reason they let me drive away was because they checked my cover note which clearly stated I was ok to drive a normal car.
So now what I have to do is when I goto to court is take the producer receipt and my certificate to show I was insured at the time which will mean I dont get points and dont get a fine.
Regarding driving the taxi I will get a fine of £155 plus the court fee.
Is there a need show you were insured after being let go or are the police just chancing their luck.

As the car had been off service and there was no radio or passengers in the car, they stated they would look at it as a special circumstance.
I took my insurance documents and I have a valid licence.
They said due to the circumstances I was mislead into believing its a normal car.
Council were asking for £400 costs.
Final verdict was £85 costs and no points.0 -
great result for you.0

Before I add to this let me just be open about my position. I am a motor trader AND a part time taxi driver.
Even though I have a taxi badge I still have to have seperate taxi insurance aswell as my traders policy as the traders wont cover the taxi whilst plated as with the plates it can be used for hire and reward.
Also when the police removed your plates and let you go on your way technically there was another offence. The taxi plates, front and rear, and taxi disc displayed in the windscreen are in lieu of a "normal" mot. With these removed and the vehicle classed as a "normal" vehicle it should now be MOT'd before being used again.
The mechanics that work on my taxi when it's in for test also cannot test drive the vehicle on their traders policy due to the point mentioned above. Re the part time traders insurance. This is available as mine was first taken out on this basis with Equity Red star, I think tradex offered it at that time too, not sure if they still do.0 -
Thank you for posting the result golfergti, I won't say you "got off" but it also shows the courts appreciate the ludicracy for Motor Traders using/test driving a private hire vehicle.
I specialise in Motor Trade insurance, and try to close all the grey areas for my clients, but the taxi rules leave all my customers open to prosecution. If only the government would pass a bill to state a trade plate supercedes a "plated" vehicle, that would be a start.0 -
thing the way they say it if a car is registered as a taxi then you need seprate taxi insurance.
Council were claiming £400 costs and there wasa potential for points also.
I was glad the court understood I had no intention of driving as a taxi and it was just cos i thought it was a normal car.
So im happy with an £85 fine0
