Court hearing for driving without insurance

    If the police say you have no insurance they usually fine you £200 and 6 points and can take the car till you have insurance.

    Did they do this to you ?

    How did the council even know you got pulled over by the police ?

    Was it a joint council/police operation targetting illegal cabs ?

    yes it was a joint thing, They took the plates and then car was a normal car so I was able to drive home, I then later went to cop station and produced which was fine.
    I am not a cab driver nor do i ever want to be. I had no passengers, no radio or phone.
    I was going to uni for a lecture and my car didnt start and that car was parked up. I even showed them the petrol reciept and the can was in the back.
    Now its the Council who are prosecuting me.

    Oh dear, it sounds like you may be just an unlucky innocent person then. You had the reciept, you had the can, you had no passengers. You need proper legal advice and to go to court, if the judge believes u he will let you off.

    The woman who gave you the key and lent you the car to get petrol can be your witness.

    On a slightly facetious note I would have thought that somebody in the motor trade would understand the concept that a car generally needs fuel to work?

    It would not have been 'classed as a normal car' as it was plated. As it was still plated then you were not entitled to drive it unless you held a taxi badge at the time. That is your real problem - you were driving a vehicle which in law you were not allowed to drive, so your insurer will not provide any cover for that. Most English Councils do not allow anyone who is unbadged to drive a plated vehicle, even if it is for SDP only. Generally only Scottish councils allow this.

    I'm not sure that showing them a petrol receipt proves much other than you bought some petrol! It certainly is no useful defence as you were driving illegally even if the trip was for SDP only.

    When they sent initial summons I decided to accept guilty so no need to go court which was on letter but now theyve still sent me a summons?

    proc wasnt on about taxis, he was refering to the bit about a car needing petrol to work
