    with that i may as well have taken him up on his agreement at least then i would be 2 grand better off, although unemployed i can find another job.

    If he is carrying on then the post you hold is not redundant and he will look to make savings elsewhere.

    If those cannot be found he may yet make your job redundant.....

    had another discussion with gaffer, and it turns out he is going to make me redundant imediately after signing some paperwork (no doubt solicitors will NOT be present as he is a cheap skate)

    but instead of me leaving he wants to hold back my redundancy and pay me weekly over the next 6 weeks (out of my redundancy) to work till shop closes on 6th june and then pay me the remainder on last day.

    now, just wondering if i sign whatever he prints out and no solicitor is present to countersign then isnt the document worthless?

    if i can play this through and then afterwards make a claim for my 12 weeks notice forcing to pay the rest of what is owed?

    Does the 12 weeks take you over another years service for 13 weeks redundancy


    Hold out for minimum 12 weeks notice pay(worked if necessary) and 12/13 weeks redundancy

    no i JUST qualify for 12 weeks notice, he is unwilling to change his offer and when i challenged it originally he pulled it off the table

  • i wouldnt sign anything. As McKneith advised earlier the minimum you are entitled to by law is

    12 weeks redundancy 1 week for each full year of employment (1.5 for any year over 41 years of age)
    (capped at £400 per week)

    You are entitled to 1 weeks notice for each full year of employment

    You are entitled to any accrued holiday.

    He can make you work your notice but that is it. Have you phoned acas?

    (I know this as i have just been made redundant myself but as the company has gone into liquadation i have to claim from the goverment, they only give you the bare minimum)

    not phoned ACAS yet, i have spoke to them before about this and they relay what you are saying

    i will wait to see what he wants me to sign and take it from there, might seek advice from a solicitor

    Redundancy pay is not notice pay or pay for actually working! So he cannot do what he is proposing.

    If you work, you are paid and have tax and NI deducted from it - and he pays employers NI.

    He has to give you notice which runs from the day after he gives it. He has not given you notice yet.

    For a true compromise agreement, you need independent legal advice (which the employer has to pay for). I don't see a solicitor advising you to accept swindling HMRC.

    had another meeting with my boss

    a couple of weeks has passed since the 'offer'

    he now wants to make me redundant with immediate effect, then withold my redundancy pay until 6th jume, to ensure i work till shop closes, whilst i sign on

    i am thinking of accepting his offer and then take him to a tribunial

    he does not want me to sign anything, so surely he doesnt have a leg to stand on
