Odd Ebay dilema.

                    Bought an item in february from seller on ebay, item didnt turn up, seller asked me to wait for 15 days (as advised by PO) eventually recieved a refund, but only for the item amount, after a bit more messing around they refunded the P&P too.
Now heres the dilema, yesterday it turns up. I contacted the seller as it belongs to them since they refunded me, and they have told me I have to to pay for it again, which perhaps sounds fair enough.
However the complicating factor is that the item was described as 'new' but its not, the box is very tatty and the item has obviously been used quite a lot. Infact had it turned up on time, I would probably be considering a SNAD.
What would be the best course of action? I dont want it as its not new, ive been refunded, and its not rightfully mine.
The only thing I can think of is to pay for it again (if thats possible after a refund) and then do a snad claim, but that sounds silly.

            You have been refunded, so your transaction is complete. As the item has now arrived it either belongs to the seller or Royal Mail if she/he claimed for the loss.
 Inform the seller that the item is with you. Advise them it can be returned to them, if they send you a completed and paid SAE.0

 Oh it had'nt even occured to me that the royal mail may own it!
 I havent had a letter from them about it, I always assumed if the seller claimed from RM that RM contacted the buyer to confirm its not arrived?
 When I contacted the seller to say it had arrived, I asked if they wanted me to send it back, but they said I needed to keep it and repay for it.0

            AFAIK RM don't send letters to all 'losers', just a random selection.0

            I would let the seller know that you do not wish to keep it and you won't pay for it to be returned. It is however available for collection or that you will take it to the post office, if the seller wishes to send a SAE for you to return it to them.
 They should think themselves lucky that you let them know it had eventually arrived, as some people would possibly have kept it.0

            Don't pay for it again if the item is not as described as I'm not sure you will be able to open another dispute with Paypal or Ebay.
 Contact the seller and tell them you are happy to return the item as soon as they have sent the cost of return postage to your Paypal account.
 The seller has probably claimed from Royal Mail if they have asked you to wait for 15 days, so in this case I don't know who it rightfully belongs to - Royal Mail perhaps?
 It's up to the seller to arrange to reimburse you for postage costs or arrange for collection of this if they want it back.
 Normally I would say it's correct to pay for an item if you later receive it after a refund but if it's not as described then I wouldn't.
 You did the honest thing and contacted the seller to tell them it had arrived so just contact them again and tell them you're not happy with the condition and if they want it back they can send you the return postage.
 The seller does not like the most helpful as they did not initially refund your 1st postage costs as they should have done.
 I suppose that it will depend on the value of the item whether they will want to pay for its return but you should not be out of pocket for an item not as described.

 LOL - I wonder how they are expecting to enforce that! Tell them they are welcome to arrange collection of it and leave it at that. Or if you're feeling really kind tell them they can send you the money for postage and you will return it. Unless its a really expensive item, I can't see them taking it to small claims and even if they did I reckon they would lose. If I was the seller and the item was fairly low value I would just tell the customer to keep it for being honest.When I contacted the seller to say it had arrived, I asked if they wanted me to send it back, but they said I needed to keep it and repay for it.0

            Well they emailed back, still quite adament that I need to pay again as I ordered it, they supplied it, and now I have it, and that its not their fault that it took RM a long time to deliver it.
 I responded again and said I did not want it, ive been refunded and that it wasnt 'new' as described in the listing anyway.
 I now regret telling them this, as they have now emailed back this morning saying that if I feel the item is 'not as described' and as they have refunded, then I have to return it at to them at my own cost..feel like ive shot myself in the foot now:o.
 I know this is true 'in theory', as a few months ago I had a problem with an item of clothing that was SNAD, and got advice on here that yes, I could get a refund, but would have to send it back at my own expense.
 I understand that returning the item is usually done inorder to get a refund though, and as I already have a refund, (for different reason) They should pay for return postage, so perhaps I should just wait and see what they do.0

 I mean for them to arrange for the collection of it via courier, not in person.
 The transaction is complete, their case is now with RM really I would have thought. Maybe suggest that you hand it back to the postman, as by now they would probably have had a full refund.
 You were very good waiting for 15 days to get your refund in the first place.

            I wouldn't bother communicating with them anymore. If they message you just reply, 'I will need a SAE or postage to be paid before I can return the item'. Everytime they message just reply with the same thing until they either send postage or forget about it. You do NOT need to pay to return it.:j30/7/10:j
