Hi, I need your advice I am on CSA 1 and I have just had a phone call off CSA as a new claim has been put in so I am now being phased onto CS2. The thing is the new claim that has been put in is by the NRP partner who he is STILL with and still LIVES with is there anything I can do?

Going back to the original post unfortunately it is the CSA system that has engendered this situation by setting more than one calculation system. I feel it's like going into a shop for a pint of milk and being told you have to pay £2 because you came in first. The person that came in after you is on the new payment scheme and only needs to pay £1 - for the only reason that they entered the shop second - not because their income is any different to the first person.

What your Nrp is doing may be dishonest if they truly are not splittiing up, but if they are like us and are paying approx double on CSA 1 than they would on CSA 2 and can do nothing about this I can understand it. If there were no other systems in place and that was the only calculation based on my OH's income then we would just have to bite the bullet and get on with it - because there is another system on which we would pay significantly less it leads to bad feeling and discontentment all round, and I'm not saying it's right but I can understand why people resort to these measures.

Take our situation for example - by the time we finish paying we will have paid mmore than £90,000 on CSA1. If we were on CSA 2 by the end of our time we would have paid about £45,000 - a massive difference as I'm sure you would agree.

(That doesn't include the arrears that we paid for the time when the case was originally opened and she was on income support and told the CSA that my OH was not paying her (as in those days she would not have been entitled to keep all of the payments) - when they actually had a private agreement and he had paid her regularly. The CSA took her word for it of course and there was nothing we could do but pay the arrears.

To add insult to injury our PWC still isn't happy with what she gets and tries every which way to squeeze that bit extra out of us - they need this and that for school, or they want to join such and such a club and will Dad pay for the gear - once when he said no and told her take it out of the money you already get her answer was to put the kids on the phone and say "you tell them they can't go then - kids you can't go because Dad won't buy you the stuff"

The only fair way would be for everyone to be on the same system, I agree this won't please everyone - what is it they say "you can't please all of the people all of the time" but at least the system would be seen as fairer and there wouldn't be people like us that feel we are being hard done by as we feel we are paying over the odds.

Oh, you mean you were paid by the MOD until '91 and the next 20 years you weren't in the MOD but were working in industry? Not quite the same.
