Do i have to pay?

Hi not sure where to post this.
I was involved in a car accident in 2003 where i was at falt, ive never heard nothing about it until today 7 and a half years later where ive just recieved a bill for £5500 for injurys the man recieved and loss of earnings. But it was a long time ago.
Do i have a leg to stand on is my question?

    I don't think I can help you, but it might help others if you provide a bit more info.

    Who has sent you the bill? Is it a Court Judgement?

    I would imagine your insurance from that time would have to pay if anything?

  • I didnt have insurence at the time. I know it was stuppid of me but as i said seven an d a half years ago.
    Its from the motor insurers bureau if that helps?

    It is ikely that any claim against you is time barred.

    The Limitation Act 1980 says that there is a time limit of 3 years from the accident for someone to take legal action against you for personal injury.

    There are some circumstances where that period can be extended; e.g. medical condition not diagnosed or becoming apparent till much later, the person injured being under 18 at the time etc.

    However, the above exemptions are not likely to apply here.

    Obviously, that limit applies to taking you to court.

    Someone can still ask you to pay compensation, They just can't do anything if you tell them NO.

    Not 100% but I think you have 5 year to file a claim for compensation , so it can take time to get everything sorted etc - unless the 6 year rule applies then i would imagine you'd have to pay. Someone more knowledgeable will be by soon!

    The MIB will have been named as the Defendant in the court action when the other side claimed compensation and they will then chase you. Although the accident was 7 years ago it is possible that the judgment was more recent. Do you have any further info as to when they say the money is owed from?

    Have the MIB taken you to court yet do you know? xx

    Good point. They might already have obtained a court judgement without your knowledge.

    What does the letter say?

    They've been doing this to other people recently without previously having been to court.

    But who knows here? However, if there is a judgement they would surely mention it in the letter?

  • On the 19/11/2003 you where involved in an accident. As a consequence the named claiment suffoered loss of earnings including legal costs totalling £5,283,90 as you were at fault the mib has made payments in the above sum and the claiments subsequently assigned their cause of action and any rights, title and interest therein to the mib.
    This account will be operated on behalf of the mib by banner jones solicitors and it is essential all payments are made to them.
