Morally - yes
Legally - maybe. It might be barred, it might not. We don't have enough information, there may be reasons that the limitation period will be over-ridden. There was a recent HoL claim where a rape vicitim was able to avoid the limitation period. Can't remember the exact details of why but I think it came down 'it'd be insane not to let her'.
So, my advice, pay up or agree a payment plan. It's only fair and in fighting it or ignoring it you might avoid it, but you might not and if you don't, the costs will escalate.
Were you done criminally for this? Anyone know what the statute of limitations is for that?0 -
Perhaps I mistook what the OP meant by 'have to pay'.
A clearer question would be: 'Can I be forced to pay?'
That is a difficult one.
Compensation claims can take years to settle.
The MIB has, sadly, dealt with thousands of cases very similar to the OP's, so they ought to know what they can and cannot do to recover what's been paid out.
They might be trying it on with threats of court action - a lot of organisations do - but in this case I wouldn't count on it.0 -
As said, they really need to take some legal advice on whether any threatened county court claim is time barred or not.
