Do i have to pay?

    Your recklessness caused loss and injury to the other party, so of course you should pay.

    Do you have any money?

    Or more to the point, is there a reason for the MIB to think you have money?

    Most of the uninsured drivers the MIB pay out for will be lawless young men in their early 20s, who have nothing to their name other than a record of motoring and other offences.

    The MIB know such people would never pay/could never pay, so there's no point in chasing them.

    So, MIB have...

    a) Not taken legal action against you.
    b) Admit that the "cause of action" that they would base any clam on now would be November 2003.

    So, in other words, they are well and truly timed barred against taking any legal action to recover the money now.

    show any CCJ against you in this matter, but if they are saying that county court proceedings will be issued sounds like they havent yet been to court.
    I all have learnt is from others on many sites.
    Seek legal help if unsure.
    Dont pay Private Parking tickets - they are mere invoices.

    Morally you are correct. According to the Wikipedia entry for the MIB, the cost of funding the organisation is about £30 per legally insured motorist per year.

    But it does appear that they've left it too long to pursue the matter.

    He is not here for judgement on whether he should have had insurance or not. Of course he should have had insurance but that is not for me or you to judge. Like I dont judge people that have alot of debt that come on here.

    Maybe the 3rd party should have claimed sooner or maybe MIB should have also.

    Well, I think you maybe seek some legal advice?

    If no legal action has been taken personally against you regarding the accident, then it may well be time barred under the 3 year limit now.

    However, I am wondering whether any later judgement by the claimant against MIB (if there ever was one) can be treated as a new/fresh cause of action. Perhaps with longer time limits? Somehow I doubt it, but it may be wise to take advice.

    As they are threatening court action against you, it is clear that they cannot enforce any payment against you without taking you to court now.

    It's just a case of taking advice as to whether they are now time barred against doing so.

  • Thanks for everyones advise, and yes i know it was a silly thing to do but hey whats done is done, just a bit shocked coz its come out the blue after so long thats all :(

    It is difficult though king, I always want to be non-judgemental but some of the things that come up on here......there are people here who get into money trouble, have a light bulb moment and want to pay off/settle their debts.

    Then there are others who are essentially on the run.

    I don't contribute much here or know that much but I do try and help, but it is difficult sometimes not to feel at least a pang of annoyance when you read some of these postings.
  • I am in debt which im trying to sort out which is why im on this site asking advise. Im paying off all my debt which is taking up nearly all my wages and if i end up having to pay for this then godnose what im going to do!
    Im not running......im just getting advise!
